Our small business was robbed for nearly a million dollars! If you own, or someone you know owns, a small business they had better make sure their bank is highly secured before letting them have your money. Our story has now gone national. These cyber attacks are happening to businesses in the U.S. 5-6 times a week and BILLIONS of dollars have been stolen by foreign thieves. One more sign that a lot of banks are out of hand. In our weekly operations meeting we just talked about cyber attacks and the ways we are preventing it from happening. Wow...I am sorry to hear about this. Have they said what their course of action is?
ETA: man I just read that article....wrong wrong what the bank is doing. We actually had something very similar to that happen here but it was caught. Now for wires when they fax or email an outgoing wire request to us we have to call them and verify everything over the phone whereas before we just verified a signature...we quickly changed our proceedures.

Oh yes! This story has exploded this week! My husband, Troy, will be on a news radio broadcast on Sun. and that is just a start. It is hitting all the newsfeeds, today or sometime this week. It would not be a surprise to hit the Wall Street Journal very soon. It is a HUGE crime that has gone unnoticed by the puplic but the banks are getting away with not taking care of the small business owner when it hits. There are laws on the books (Fair Credit Act) to protect the individual but when it comes to businesses....THEY ARE ON THEIR OWN!

Hey y'all were very lucky for catching soon and having a bank that is PRO-ACTIVE. We have become experts at a cost of $200K+. We are very lucky to still be able to do business, but most small businesses have been wiped out when they are hit for several hundred thousand. My husband has been unable to even eat lunch today, they are getting bombarded with calls from all over the country from news agencies, businesses that have been hit and lost everything, and just individuals supporting our cause. PlainsCapital will wish they never messed with us. I think they thougt we were just a small business that would not fight back...they had no clue.

You know what I don't get is the bank is saying this.....
PlainsCapital is asking a U.S. District Court in Texas for a declaratory judgment that its security procedures are reasonable and that it didn't breach its obligations under a commercial account agreement.
So does the bank not require a signature for a withdrawl? Obviously you guys didn't sign the form so it was a forged signature....how can they argue with that? Wow....somehow it's always the victims fault. I'm sorry you are going through this.

Sure, if his consumer bank account had been targeted by Romanian hackers, federal laws would force his bank to make good on the loss. But these laws do not extend to commercial bank accounts.
"When you sign up for a business account, it will say that you are responsible for these types of incidents," said Avivah Litan, a security analyst for Gartner, an information technology research and advisory company. "It may not say it very clearly, and it's in small print, but the banks are covered by their contracts."
What I find interesting is my bank requires you to come in and Sign in person for a wire transfer of funds Wonder if this is their way of protecting against this type of thing I am SHOCKED Kaycee that this happened to you! I so hope you get your $ back!

We feel sooo honored to have the people on board that saw our story and want to make our story an example for the banks. We are putting the fear of government in them! NO, they don't require a signiture!!! Just a username and password! We have all the anti-virus software, so we had no idea the thieves were so advanced. Most of the BIG banks have been proactive in their sucurity but PlainsCapital, GULP! We HAVE never done overseas banking with this account and when the wires started to hit it should have been a HUUUUGE red flag to the bank but they never caught it !!!

Thanks SG! Your bank is right in having you come in and sign as an idividual (private citizen) but when it comes to banking with bussinesses it would be VERY inconvient to have to go to the bank EVERYTIME your business does a wire transfer. Many of the banks are adopting systems where you have to have a "token". Remember in the article where PlainsC. says they have "reasonable" security? How would you like to hear that from your own bank? LOL "Yea, it's reasonable..." UGH!

When this first happened we went through all those stages of grief and literally thought we were doomed! Our attorney gave us some hope but still you are thinking that you have just lost a huge amount of money! My husband was instrumental in finding some VERY heavy hitters in the bank security business and we have a very, very good chance in being made whole again!

Your bank is right in having you come in and sign as an idividual (private citizen) but when it comes to banking with bussinesses it would be VERY inconvient to have to go to the bank EVERYTIME your business does a wire transfer. Many of the banks are adopting systems where you have to have a "token". Remember in the article where PlainsC. says they have "reasonable" security? How would you like to hear that from your own bank? LOL "Yea, it's reasonable..." UGH!
Nope my business account requires one of us to have to go in person to do it They won't do it any other way. I know there is times this is a pain but after reading your story I am glad they have this policy

I would think attorneys would be jumping at this case too. I think you will get your money back. This to me is clearly a bank error and they need to own up to it. LOL We have heard from so many banks that are just floored that this bank is suing the customer! It is unheard of.

I am sooo happy that your business account has that security. I hope our story will make others(businesses, especially) aware.
