Location: wherever my daughter's running | Have read that Justin Boots bought the horse, and also read that a banker with the last name Montgomery got Latte. Do you know for sure it was Justin Boots? Not being snarkey --- just curious who actually bought him. At any rate looks like he will remain with Mary and I suppose Byron. |

Location: Alabama | So basically that means that the smaller part of the original LLC banked roughly $85,000 while the larger part banked around $765,000 and retained possession of the horse. Seems like a smart business decision to me... |

| Well if he was not there I need to find out who this look a like it and remarry!!!! And I would like to apologize to anyone if I was misinformed. I like many of you just wanted to know what happened. On a thought though if he was there I highly doubt he was like look at me!!! And unless you paid attention he would probably just look like an ordinary stand by. The people that were at this deal I am thinking the last thing on their mind was a celebrity. They came with a purpose. |

| Generally auctions require a Letter Of Credit from the bank and then they have 4 hours to send the wire. But before they can even get a bidder number they have to provide a letter of credit for the minimum opening bid. In this case that was only $20,000. |

Justin Discount Boot is a completely different entity than Justin Boots. Also per a Google Search Mike Montgomery is CEO of First State of Texas located in Ennis, Tx. Which just happens to the Hailing Location of Byron and Mary Walker! |

Got documentation to support this claim? Yep, straight from two sources that were there bidding on him. We've been told 850,000 and 875,000. Which is it? $850,000. I video'd it and the aucrioneer said SOLD FOR $850,000. I'm sorry for my Op I meant $850,000. OK thank you. I was just curious because Canchick posted 875 also. I guess when it's that high whats another $25,000. Chump Change! Lol just chump change. I was going to post the video but it won't let me : (.

Ya I just want that one poster to come back & explain her post. I have no connection to either party but I hate to see the person behind the scenes get screwed. Nobody is above the law & if you're an honest person a contract that you willingly signed should be honored. But I guess I was raised different than a few other posters on here & facebook. |

This is America where we say one thing and do another and when someone holds us accountable we smear they're name in the mud and use our celebrity status as a platform from which to sick our troops on the one person who is admirable in this whole thing.

Glad to see mary still has him though. Shame on Cheri Why? yea... I would like to hear the response to this one....
Cause well Im gonna throw this one out there... cause she held them to their word? which apparently means diddly to them even when the sign the dotted line?
If I was their bankers my wavo's would be sweating...
Come on, Cindyt.....everybody knows you don't have to keep your word anymore. This is America where we say one thing and do another and when someone holds us accountable we smear they're name in the mud and use our celebrity status as a platform from which to sick our troops on the one person who is admirable in this whole thing.
LOL... I must have hit my head....

Shame on the one who stirred this up to begin with. It was not either of the two involved in the contract.
Cheri ended up getting less than what was offered to settle.
The reason he went so high is that Walker's, who are keeping him, are getting 90% of the sale. What they are actually paying is 10% of the sale price. |

I don't think the 10% of the sale is all she gets. I believe she still has court action pending on other monies owed...i.e. earnings... |

Mike Montgomery who is a representative of Justin Discount Boots Outfitter bought him. Mike is also 'heavily' involved w/ the Walkers. Google Mike Montgomery and see what his professional background reveals for yourself. Then make your presumptions and forecasts............... |

If you think someone actually purchased him for that amount I highly doubt it, they had a friend run the money through and ultimately will only pay the 10%. Borrowed money for a few days so to speak, which will go back to the lender minus the 10%. |

Didn't read all the thread so don't know if this has been said but it's not the owners of the brand justin boots it's the name of a store in justin, tx. Justin's discount boots. They may carry Justin's but are not affiliated other than that.
That's what I thougt...it's a discount boot store in Justin, Tx, NOT a Justin Boot Company store. |

| Howdo you guys know who is wrong or who got "screwed"? For those that know what's in the contract, does the lady wanting 10% of earnings pay 10% of entry fees, vet, farrier, fuel, feed, etc? What about 10% of Mary's medical expenses when a horse she partially owned injured her?
Dont anybody go off on me I've really been wondering this... |

The only amount paid out is the roughly 85k. The other money was cycled through the bank to please the legality of the entire mess. If you think someone actually purchased him for that amount I highly doubt it, they had a friend run the money through and ultimately will only pay the 10%. Borrowed money for a few days so to speak, which will go back to the lender minus the 10%.
It well be more than few days. The money will be deposited with the court and may or may not released until the two cases are resolved. That is up to the judge. This case has along way to go yet. |

I think the IRS would say yes. |

So, if I am understanding correctly, someone else purchased Latte and gave him to Mary... Therefore, is he officially hers or does he belong to someone else and she will just be able to continue riding him?
Mike Montgomery who is a representative of Justin Discount Boots Outfitter bought him. Mike is also 'heavily' involved w/ the Walkers. Google Mike Montgomery and see what his professional background reveals for yourself. Then make your presumptions and forecasts...............

If I were guessing...the new "owner" only fronted the money. As for the Walkers taxes..I believe when you sell an asset like this you owe capital gains tax....UNLESS you reinvest that money within a certain time frame. So, I would think the smart thing to do would be to buy Latte outright from the winning bidder, once the money is dispersed by the court... thereby negating the tax obligation. |

The key is how long will the court take in dispersal of the said auction proceeds?

If you people would slow down a little bit, and get your head outta your a$$, you would realize this is not how the court system or law works.
There is a pending legal case here that is still NOT SETTLED. As far as one getting 90% and the other 10%, that has not been decided in court. The total actually owed is being debated, and Cheri could possibly, and will very likely, get more than "10%" ya'll are so fixated on.

Not sure who else was there bidding. That's exactly who I figured would be in on it. Sounds like there were a few people of the same ilk there today.

What I find interesting is how the "image" attached to this particular case has swayed so many peoples morals. For the most part, there is talk on here almost daily about being a good person, following the rules, etc. But because of the tragic story attached to this combination, the morals that most people on this board profess to follow and hold other people to, have been thrown out the window. I wonder if the reaction would have been the same or different had it been, say, one barrel racer that we are forbidden to talk about on this board and her mare? |

And how the rules can be bent and twisted depending on who the person is......as if there are 2 sets of rules and your image dictates which set of rules applies to you. |

Just a step that had to be done. The court will now disburse the money to the parties involved based on the courts calcualtions of who owes who and how much. |

I wondered the same thing.....and have assumptions as well and agree about the "assume" analogy. Not on here enough to follow who's OK to discuss and who's not. Don't want to break any rules so I usually just read and keep my opinions to myself!
That being said, I find Mary to be an inspiration after what she's been through however like someone else said-if you have a contract you have to follow through with what you've agreed to. |

Had said "Contract" been fulfilled by ALL Parties involved, NONE of these proceedings would have occurred. |

Location: South Central Florida | I don't understand why some people criticize other people talking about a major horse situation on a horse board?
For those that say it's no ones business....neither is any othe sport or athletes, but we read all kind of stuff about their businesses, their lives, their injuries, their being traded or going free agent etc. . . NFL and NBA players have their saleries posted every wyere, so why is interest in this story any different?
I have no feelings or knowledge about the story, but I would like to. Emotion attached to the sale and story are part of life...
I will be anxious to see how the rest of the case plays out.
Another thing that gets me a little is that several of the posters that sort of "fuss" at us nosey busy bodys, have made very questionable remarks about the Walkers...and the likes of them etc. . . as well as the name of the person that was listed as the purchaser.
Yes lots of confussion, but half the people here that have factual information are afraid to post it because they will get deleted or the thread frozen. I'm not going to believe that the Walkers are less than honest, or that the other party is less than honest. It COULD be, maybe not, but could be just a difference of opinion on the merrits of the original contract. That can happen.

Justin Boots paid for all of Mary's medical bills ... go look at her NFR interview ...
The rest of the expenses are usually with the person buying the horse .... LLC tag means there is a payback on winnings and increase in assets to be divided and could include the unpaid portion of the price of the assets ... ...
Looks like to me Mary's hubby used to be an insurance agent // broker and had all bases covered with proclaiming Latte is now injured ...
Post on Walkers FB ... Thanks to the new owners I have a lifetime mount ....

Oh ok I understand... Makes perfect sense...thank you. |

Interesting...good question. Definitely didn't think of that
Justin Boots paid for all of Mary's medical bills ... go look at her NFR interview ...

True but the figure will be more than 85K. Cheri is owed more than her ownership share. She is also owed the percentage of winnings she was never paid. The court will decide this amount and the funds for Latte will stay in escrow till this is all settled which could be a while. |

Clone him and make all sorts of little Latte's, if it hasn't already been done |

There was a correct observation earlier today that 'He' is now worth dead than alive due to this auction.

From public court records this is far from the first time this couple have screwed over business partners. I think that is why the general public have changed who's corner they are backing. I know it changed my perspective of things. I really could care less either way, but I hate to see bad things happen that is public notice. |
