Court of Appeals panel ruled Tuesday morning that customers in the 36 states that didn’t establish their own exchange and use HealthCare.gov instead cannot be given premium tax credits, according to the text of the Affordable Care Act itself. White House press secretary Josh Earnest said that while the case continues to be battled out in the courts, the administration will continue to dole out billions in tax credits to federally-run exchange customers.“It’s important for people all across the country to understand that this ruling does not have any practical impact on their ability to continue to receive tax credits right now,” Earnest said in a press briefing Tuesday.A three-judge panel issued the ruling Tuesday, concluding 2-1 that the federal subsidies are illegal. The Department of Justice is seeking an en banc ruling from the appeals court, which would require all judges in the court to rule on the case. Eleven judges on the court would hear the case: seven Democrats and four Republicans.That decision will likely also be appealed to the Supreme Court.

Meanwhile I would imagine our boarders are still being overrun. Other world events have center stage right now. Did see where Gov. Perry is sending the National Guard to the boarder on Texas' dime. Putin is spanking us again. Suicide bomber in Benghazi, and of course the Gaza strip. So much happening. I guess I am extremely old fashioned. As times like this I would like to see the president of this country in the oval office speaking to the nation. I do not care how many gadgets he has to keep informed of what is going on and in communication with whoever or how many times his head of FEMA has been to the boarder. It is not the same as him making his presence clear. Can his wife not do some of this fundraising stuff solo? If I am not mistaken, 1 week from Thursday the Senate adjourns for a break. Prehaps he has work to do at home. Just boggles the mind. |

So far my husband's doctors are still taking Medicare. For how long...who knows? He's an established patient and I do think that helps since he's been using them long before he was on Medicare. I'm sure it will be much harder for me since I don't really have a doctor. |

| I was listening to MSNBC discuss a lawsuit in Virginia from someone who does not want to be forced to by insurance, someone who wants the freedom to decide for themselves. Their argument is that you are taking away others freedom to buy insurance, especially those who need the susidies to make it affordable and how immoral it is. Funny how not once did they offer the solution of making the ACA optional so everyone has the freedom to decide what insurance they want, would solve a lot of issues but then of course if they don't shove it down everyone's throats they can't pay for it. Their freedom is defined as making you do what they want and what they decide is best for you. |

I actually chose a new Dr. based on the fact they didn't take Medicaid. I feel I get better service and my concerns are met with more care. |

    Location: lost in missouri | My question/thought is, not that it will probably ever happen because Obama and his croonies will make sure we always have ACA, but what if they r ruled to be illegal subsidy payments, we as the taxpayers are owed that money back. Do you actually think they will be forced to pay back the money they got in illegal subsidies my guess is no. it will just be wrote off. There is no way the people who got the subsidy could pay it back since they cant afford healthcare to begin with and i doubt the insurance companies will be made to cough it back up, i mean they are the main reason we have this mess. Would it not be wonderful for every business and service to be able to put enough money in campaigns to buy their way into their goods and services being made law that the American consumer must buy their goods and services. This country is really going down the drain. What really gets me to is how many people do not see ACA as an infringement on their freedom? really? a govt telling u what u have to buy is not an infringement? |

The case centers on a brief description in the health law that says subsidies will be available "through an exchange established by the state." This was taken from CNN's website. No matter what the "intent" of this statement to me it cleary states an exchange established by the state. It does not say anything about the federal exchange allowing subsidies. I am sure this is one of many things not caught/read in the thousands of pages that make-up this law.
