| My worst night just happened. We live on a highway. One of my horses got out, was hit and killed. My favorite horse.
I'm hoping our homeowners insurance will cover everything, but does anyone have any experience with this? A minivan hit him, and my husband said it appears to be totaled. They took the driver to the hospital, but the cop said she was up and walking around. I am so numb right now, I don't even know what to do. |

     Location: Oklahoma | I am so very sorry for you. I think a lot will depend on your state's laws about fencing in or fencing out and open range. It can be very confusing. If you post your state, maybe someone who is familiar with that can tell you. |

| I'm in Missouri. I am 99.9% sure we are responsible, given what friends of ours have had to deal with when one of their cows got hit. I'm going to call the insurance company first thing, I just hope that it will go smoothly. I have no idea what our policy states about issues like this. We have a $1000 deductible, so I know that will be the bare minimum cost.

| I am so very sorry! I gave an old horse to a neighbor of mine and he didn't shut the gate and the horse got hit on the road in front of our houses. The driver's insurance covered it - althought they tried to sue my neighbor - nothing ever came of it because it wasn't a "habitual" problem of him having horses get out. I'm in Kansas though, could be different here. |

 Location: Oklahoma | I went thru this exact thing in 2010- it was awlful. We had her since she was 5 months old and she was 6. I feel for you. I was very glad the driver wasn't hurt- but it was a sad day for missing her. In Oklahoma- there is a dumb animal law as long as the owner doesn't have habitual issues with horses being out etc. The drivers insurance paid for her vechicle.
Prayers for you . It's so hard in so many ways. I NEVER want to see anythign like that again. Luckily Rey was killed on impact. |

        Location: NC | I am sooo sorry for your loss. I am very glad that it sounds like the lady was ok. This happened to my husband and I while we were younger. I use to keep my horse at his parent's house. one year someone down the rd was shooting illegal fireworks and they ran through the fence. luckily a big 18 wheeler hit the one horse so no one was injured, though my husband's horse died and mine was clipped and injured and not found until the next day. it was such a traumatic experience. I was younger and it wasn't on my property so I didn't have much to do with the details. but I believe the drivers insurance covered it but they did come check the fence and make sure it was appropriate for horses. |

| I had a horse get hit and injured pretty badly in 2009. He was side-swiped not hit broad-side by a semi. The semi had what the cops thought to be about $5,000 - $6,000 in damages to it. My vet billed (covered by insurance) was in the neightborhood of $8,000. Anyhow, I thought for sure we'd be hearing from the semi driver's insurance but we never heard a word. My horses got out of a gated pasture and then the one also went over a cattle guard. We think he injured himself in the cattle guard as much as he did with the truck side swiping him.
I'm so sorry for your loss and the stress that this has brought you. Prayers for all involved. Just think be very thankful no one was killed and think positively that all will work out fine.

Luckily my husband went down and identified the horse, so I have not had to see him, but from what my husband said, it's pretty bad with lots of blood on the highway. I feel so horrible because Harley has to lay in ditch until my husband is able to get off work. I went into work today because the other horses were calling out for him and it was just ripping my heart out.
When I called to make the claim, the woman that took the call has horses also and started crying when I told her what happened. It's been incredibly emotional trying to process this.
To top the morning off, my vehicle wouldn't start so my coworker had to come pick me up. |

Is MO a fence in or fence out state?? That will determine what insurance will cover for the loss of the horse and what your liability insurance will cover due to the accident ... |

My silly hubby forgot to lock one of my horses stalls just last Friday and thank god he stuck around the barn all night. I think if both had gotten out it would have been a different story. But I can't imagine what you're going through.  |

              Location: Under The Big Sky Of Texas | Oh no so sorry to hear this , it hurts no matter how we lose a horse or a pet. I know here in Texas if on a farm to Market road we are not liable for livestock being hit but on State highway we are liable. Hope the driver is ok, I have seen a few accidents between livestock and cars/trucks and most drivers are not so lucky. Prayers that this gets taken care of fast so you can get it all behind you.

         Location: SW MO | We had this happen a few years ago. We turned it on our home owners insurance & they paid. They first had to come out and see if we were responsible. A gate had been left unlatched. You have to have liability on your livestock for it to cover it |

I had a horse get out and got hit by a truck around18 years ago. The people who hit my horse didnt go to the hospital. Their insurance covered their truck and got them a brand new one. They called us once to see if we could give them money to fixed their damaged truck. The truck had been damaged before and they wanted us to fix it like new. We were going to court but their insurance company didn't make the effort to come to court. I lived in south Texas and their insurance company was in Austin so they didnt feel the need to drive all the way down. Plus our lawyer told them how they contacted us wanting money which is a form of harassment |

Get your policy out and read it very carefully. Insurance companies are sometimes guilty of not paying if they think they can get away with not paying. Educate yourself and don't just assume that what the adjustor tells you is correct. Your policy tells you what it includes and what it excludes, often times there are endorsements done for individual needs of various homeowners that your agent will set you up with. Some policies have what's called a "Country Squire" endorsement for horse owners. If you have such an endorsement (may have a similar name for different companies), you've paid extra for it and want to make sure you get what you paid for. |

Thank you for the advice. We already decided we are going to be looking at our policy and see if there's anything we need to add. My mom mentioned that she has a $1mil umbrella policy in case anything would happen at their place, I'm wondering if we might need to do something similar.

| I would also double check the state laws regardless! When I lived in OK, I had a horse get out and was hit...car totaled. My homeowners DID pay and then promptly raised our rates and canceled us at renewal (we also had a trailer stolen that year). It's hard to get alternate homeowners ins once you have been canceled.
I later found out out that with open range/fence out that we didn't have to cover it, his car insurance should have covered it. It ended up costing us in the long run a lot of money and headache. We had to wait three years before we could get any kind of competitive rate again. I don't know why my agent didn't give us better advice and/or know the laws :-(

| Prayers to you. This happened to a good family a few years back except it was 20 horses. They were told since they didnt have a history of this, it would be very helpful in the event of a civil suit.
Now as a dispatcher, we have several calls about horses (the same ones over and over) and if a good attorney ever pulled our records, the owners would be in a world of hurt due to the frequency and constant warnings.
These things happen and its so heartbreaking.  |

| I'm not sure why the open range laws are being called "dumb"....if you think about it..unless you are habitually having trouble with your horses getting out because you don't care of your fences....how are you negligent if your horse gets out? The laws protect the horse owner. If my horse gets out and gets hit and the driver of the car is hurt or even killed, I sure want to know that the states laws protect me against losing everything. Its certainly not the drivers fault. Its just like hitting a deer.
With that said..I am so sorry that you lost your horse. That is so devastating. Hopefully you carry liability for your livestock through your home policy. If you don't have any state laws to protect you, your insurance will be there in the event of a law suit IF you have liability for livestock. Unless you had your horse insured, there will be no coverage there. Good luck to you. |

My parents had a million dollar umbrella policy which was fortunate because the guy who hit the horse sued. He was also drunk and high on narcotics, but I guess the police didn't think that was important. He took my parents policy to the cleaners. It was ridiculous. I'm very sorry for your loss. It's been 30+ years, but that night still haunts me.     |
