| I was unaware that even after purchasing a photograph it was STEALING for me to post that photo online...here, facebook, or otherwise. I have always posed the Watermark pictures of a great photo because it was easy and because I thought that I might be promoting that photographers work, as I usually know most of the photographers personally. I was unaware that if I ever wanted to post my photo online I need to purchase the digital copy as well. NO CLUE. I have been "stealing" for years and years and did't have any idea that's what I was doing. I got accused of stealing the profile picture and several others today...all of which I bought physical photos of....I was very defensive at first until I had it explained to me. Apparently if you buy the physical photo...and later want to put it on the internet for whatever reason you HAVE to go back and repurchase that photos digital rights. I thought that I could just used that physical photo and scan it in and use that....it wouldnt have the watermark...but NO that is STEALING also. So. I'm sorry if my picture has offended anyone...chalk it up to my ignorance. I will have it changed by the end of the day....after I go back and purchase the digital rights to it.
As competitors I am not sure what rights WE have....I guess maybe we sign a disclosure at barrel races when we enter...I dont read the fine print on entry forms. And maybe we do the same thing when we fill out rodeo memberships....I dont know....maybe someone on here could explain what rights we have as competitors to have someone take our picture and post it on their webpage "without or permission" granted we havent inadvertently given it without knowing. |

| Lots of people do this and many are unaware that just because you purchase a photo, you are not actually buying the rights to it.
In a nutshell, if you are in a "public place" anyone can take your picture unless it is posted somewhere that you can't. The photographer then owns the rights to that photo unless you buy them. Buying a copy is not the same as buying the rights.

The man had a photography business with Facebook as his main platform. He would take photos and post them to the association's page the next day, tagging those that he was friends with, too. Trouble was, these weren't your normal riding/action shots. Most of them were so zoomed in on rider's chest/face you couldn't even see the horses we were riding. After many complaints, they tried to ban him, but it apparently cannot be done. By participating in the public event, you subject yourself to photos being taken of you. At least that's what we were told. The most we could do was remove him from the facebook page and our personal pages, but he continued to take his pictures for some time. |

Yes, as I understand it...by taking a picture of the physical picture in order to post in online you are stealing. Who knew....(i am not a copyright expert) |

| I had a photographer comment on my profile pic...on my page...I am assuming to embarass me...and tell me to take it down because I STOLE IT....and I have never stolen anything in my life intentionally. I was so embarrased....mission accomplished. I did screenshot a receipt of my purchase of that photo...explaining that I have PURCHASED it....and was informed that because I didnt buy the digital copy...I was still a theif. LOL...and according to the law...he was right. I was....and it sucks...I have spent the day deleting all my photos on Facebook...with or without watermarks...unless I was sure that they tagged me in that photo and run their business through Facebook. I am sad...I dont have any cool pics on there anymore. I am in the process of hunting down the photographers to buy the digital copy so that I dont have to worry about my name getting "slandered" as a theif....however unintentional. I have had conversations with three photographers today apologising for it....and asking for digital links. What a mess...

I have always called the photographer and asked them to be able to use them. Never been told no yet. I explain that they are stallion/offspring photos and I would love to be able to share them on facebook and my website. I always post a mention of the photographer if it isn't already stamped on the photo. |

| If you post a picture to your facebook page, and someone else takes that picture and uses it for profit like advertising then the photographer looses out on any income he could have made. |

I feel the same way....it is a bunch of BULL PUCKY to enable a photographer to squeeze more money out of you......I would BOYCOTT any photographer who told me that I had to give them more money for a picture that I PAID FOR and was using for my own personal use. So SUE ME !!!! |

I hear ya, I havent ever had any trouble....but most of them are my friends. These few I dont know. One was a PRCA rodeo photographer, the other was a "new" photographer that I hadnt ever purchased from. Another is a photographer that I know and always buy from...but never "asked" |

They go on the website where the photos are for sale and steal them and post them on FB. Those photographers sit there for the entire show and take photos and I dont blame them at ALL for not wanting their photos stolen. It has always amazed me when you come home from a show and see photos on FB that have STOLEN written across them. How hard is it to pay the $3.00 for a digital copy? I am yet to meet a photographer that wont throw a digital copy in for free if you buy a hard copy of the photo. Most of them are wonderful to work with and get tired of people stealing their photos. They deserve to get paid just like anyone else. However Motivated if you already paid for the photo, I can't imagine they wouldnt be able to work with you on a digitial copy.

    Location: NC | Here's the deal kids. People today have this cheapskate deal where they love to take screenshots of the previews on the websites. THAT is stealing, regardless of whether you bought the physical photo or not. If you scan it when you get home or take a picture to post on facebook giving credit to the photographer, I really don't see how that's a huge huge deal. Maybe in the fine print of the copyright law, But the whole taking screenshots of the previews to get around making ANY purchase of ANY kind is stealing, period, end of story.
And cropping out of any watermark is also stealing. If you have to crop it out, you shouldn't be using that photo unless you have express consent to do so.
By riding in a public event, you are giving your permission to be photographed. The owner or producer invites the photographer, so if you have an issue with the photgrapher, you take it up with whoever invited them to come spend ALL day in the hot sun or all weekend in the corner of a dusty musty arena with thousands of dollars of equipment for a bunch of people to complain about spending $10-20 for a download and digital release.
Photographers lose THOUSANDS each event because of people stealing their photos and not paying for them at all. |

| Honestly there are some photographers that are really good about this! You buy a $40-$60 photo from them and they are good with you using it!
I think if they aren't I just won't use them for any of my events nor will I purchase photos from them! It does not cost them hardly anything to take photos (once their cameras are paid for), and charging us $60 for a copy seems a bit extreme to me and it is definitely not worth it for a photo but if I do buy it I better darn well be able to use it where I want.
This floors me that they can be this greedy! I'm sorry to any photographers on here this is simply JMO. |

I know what a poor man's copyright for written material is. Upon completion you put it in a sealed envelope and mail it to yourself. The postmark serves as the copyright date.

I am one of those people that thought that I bought the physical photo and so it was okay to have the watermark posted online...they are usually **** good pics if I buy them and I HONEST TO GOD thought that I was helping promote that photographer's good work haha...I had no idea that they didnt keep their records to know that I had purchased the physical photo and didnt mean to "snub" them in any way. Heck I am usually giving shoutouts to the photographers about how great the pic is...I'm "friends" with them on Facebook...I wasnt trying to HIDE from them. I was just IGNORANT....I didnt know....unless you work with Copyrighted material...you arent going to know.

I purchased a copy to have as a keepsake. My Dad's point was that it was his barn and taken without his permission so I shouldn't have had to pay for it. After all the guy said it was his best selling one yet Dad receives nothing from it. Seems like the door should swing both ways. |

As a general rule, permission should always be sought when shooting on private property. Therefore a property release is required for creative collections. And consent or a permit for Editorial collections.
Also as a general rule, places that charge an admission fee or require a ticket for entry usually require special permission for commercial photography. Consent should be sought. These locations are therefore problematic in all collections both Editorial and Creative. They should be completely avoided in Royalty-Free content, while some may be suitable for Rights-managed or Editorial with the proper consent. Some locations may be free to enter (like certain museums or historical properties), but imagery taken inside may still be problematic. Do your research prior to shooting. |

| This is totally silly (I am not serious) but I refirbish old tack from time to time...my horses and usually me...because I am so smoking hot...are the "models" and I think that people should pay ME to take my picture...because theyre putting my tack, and my horse that might one day be for sale, and my smokin hot bod on their page....to promote their photography....BECAUSE we can take a **** good pic haha ....but no...we dont have any actual rights to anything if we are in a public place from what I understand....so heres to buying digital copies :)

| In Dad's case the picture was taken from the hiway so the photographer never entered his land. It's not that big of a deal but I did pay $160 for the picture. Dad told me to tell him to give me the pictures and he wouldn't sue him for his share of the profits but I didn't, I took the easy way and just paid for it. |

I think a digital copy is actually a "link" that they send you so that you can save it and upload it....its not a physical thing |

This is what I do- when I want to buy a picture I tell the photographer- what do I purchase from you that will allow me to post this pic on Facebook or on my personal website? That clears it up every time. PixelWorx is great with that...I haven't had a problem yet. There is a local guy that takes pics at races and I asked him up front, what he would allow me to do with pics and he said I could print, put online, whatever I wanted.. but some are not so lenient. |

Yes, a digital copy is one you upload online for your enjoyment, to post on Facebook and other social media sites. A hard copy is totally different (one you frame) the digital copy is normally what people steal from the photographer off their website. |

It is actually a LOT cheaper if you purchase the rights to the photo. Then instead of paying $5 for a 4x6, or MORE, you can have 20 4x6s printed through an online company for about $2 lol.
The photographer we used for our engagement photos gave us a USB with print release. I printed multiple copies of every single photo to give to family for like $10. Usually when you join a site like shutterfly or snapfish they give you a ton of free prints, you just pay shipping. |

I am yet to meet a photographer that wont throw a digital copy in for free if you buy a hard copy of the photo. Most of them are wonderful to work with and get tired of people stealing their photos. They deserve to get paid just like anyone else. However Motivated if you already paid for the photo, I can't imagine they wouldnt be able to work with you on a digitial copy.
If it were REALLY $3.00, I wouldn't mind paying for the a lot of the pictures!!!! $3.00 doesn't even cover shipping!
Digital copies around here are anywhere from $50-$60 at the least! I would pay $3 all day long!! |

I've never paid that much. I've paid comparative to what the print copy was. But again- a lot of photographers have different products. If you want a digital to put on FB those are usually cheap. If you want a digital because it's going in an advertisement- those are more expensive. |

If I want to post a picture on my fb, I will pay the money. He does great work and it's worth it for me. In many years I will be happy I have the pictures too.
I do find it irritating when I see watermarked pictures being used for sale ads. That is tacky. Plus, you can't hardly see the dang horse lol |

Thank you for making the difference between the two. I am not referring to advertising when I am quoting the price. Since the OP wasnt talking about that, she was talking about Facebook and social media. I can totally see paying more for a high definition digitial copy for an advertisement. |

The photographers are often invited to take pictures by the producers....sometimes they might have to pay a vendor fee...idk. These are just big added money barrel races....no one had to pay admission to watch. But I really thought you asked if the photographer had to pay...I have no idea what they work out with the producers. They are just public races. The RODEO photographers are contracted through the PRCA ...so they dont have to pay even when spectators do....thats where I am confused. Well it depends. The Government wanted to forbid commercial photography in the National parks that you had to pay to get into. Not sure where that went or if the law is working it's way through congress. I'm with some of the others here. If I pay for a photo of something that belongs to me, I'll post it for people to look at for free if I want to. It's no different than showing it to friends and family wherever you go. If they don't like it they can sue me and see what that does for their business. |

These digital copies are not for advertising! They are just for personal use on Facebook etc...
This is why I get so fired up about this topic. Its not right. And I haven't purchased any for a long time because of this.

| I'm a photographer and it is really frustrating when potential clients save/download proofed/watermarked photographs and post them on facebook and other places on social media . In most cases these individuals do not purchase the actual digital copies from the photographer. When I first started out I photographed a 4H show and posted them on my Facebook page and advertised them for less than $5 each for a digital high resolution download. That is extremely cheap and I gave them a discount for multiple photographs, I thought it would be a nice 4H discount and would help promote my business. Well unfortunately only a few of them actually purchased the photographs and I saw plenty of watermarked copyright photographs that weren't purchased floating all around the internet. It is one risk of posting your photographs on facebook especially since it is very easy to download any photograph on facebook and save it on your own computer. Sites such as smugmug and other websites make it harder for people to download proofs. I used Facebook for when I was starting out because it is easy to access and I don't have to pay any website fees. Social media is a wonderful tool but it has also become many photographer's nightmare.

It is an awesome picture that looks like a greeting card. I purchased a copy to have as a keepsake. My Dad's point was that it was his barn and taken without his permission so I shouldn't have had to pay for it. After all the guy said it was his best selling one yet Dad receives nothing from it. Seems like the door should swing both ways.
If the barn is identifiable then the photographer needs a propery release to use commercially (selling in any form or used in an advertisement even for charity). It doen't matter if they were on your propery or a public road when taking the shot. If they only use it for personal use no release is required |

I should be given that photo on a CD so that I can then take it to Wal-mart or any other photo store and make as many "pictures" as I like. So in that case shouldn't the digital rights be more expensive since I am essentially buying that photo and making it mine? If photographers want to play the whole you need to buy the "rights" to this photo before posting, shouldn't they then explain how that works. If I have to buy multiple forms of my photo, digital, physical, holographic, ect, I should be then given a CD of that photo so that I can then make as many copies as I want since it is then MY photo. The logic behind some of this is questionable. |

Unfortunately those that try to do right by photographers by buying photos and thinking they can do what they please with it end up getting the sh*t stick trying to regain control of their own businesses.
Whatever. The photographer shouldn't have called you out. At least you actually purchased something. He needs to either incorporate digital rights into his fees... OR make you aware. Everyone these days has some sort of online presence, that is something you bring up, especially when you have problems with "theft".
I feel sad for the OP, that photographer mad her feel like crap and I'm sure if he just said something through a private message she would have handled it. He's just being a jerk about it and needs to straighten out those panties. |

      Location: The edge of no where | Most of the photographers here are really good about it. I love the option to purchase digital downloads, that's usually all I do. If I buy a hard copy, I just tell them that I'd like to be able to post it on FB and ask if it's ok. 95% of them will throw in a digital copy for free instead of me scanning it in. What I find incredibly rude is people stealing images off a webpage and posting all over the place. As reasonably as most will sell a digital download, I can't imagine why they think this is ok. When you see them in an ad, it's even worse.....tells you a lot about the kind of person you'll be doing business with if you buy the horse. |

I agree!! I pay good money for the pictures and should be able to show them off to my friends whether in person or online. To me, it seems like greed that a photographer took a picture of ME and then I purchase it and have to purchase the digital copy just to be able to show where family and friends! BS! |

If a photographer confronted me and accused me of stealing, I darn sure wouldn't buy another image from the said person or business. I don't care what the laws are, if they are going to be ridiculous and an ass, no way will they overcharge me again for a print. I paid for the picture and I'll show it to whom I want. Maybe the laws need to be changed... And yes, I have purchased digital images as well. I just don't like photographers getting in a tizzy over nothing and like others have said, its me in the picture, so that should carry rights, even though it doesn't. |

Sorry to burst your bubble, I thought this was the case too. But actually, I was told that taking your digital copy to a "photo place" for copies was also Stealing, and that most "photo shops" would know that it was illegal and not allow you do do it....because it has the photographers name, stamp or whatever on it. JUST SO YOU KNOW> you have to buy the digital copy and that is for online, social media, etc....and if you want physical copies...then you have to purchase those as well. |

| I will say this. I apologized to the photographers...each of them on my Facbook page...and told them that I was sorry and I would purchase the digital copy for my Facbook since I often use those photos to help tell stories and include them in my little "blog posts" and sell horses with them. One of them emailed the digital photo of what was my profile picture, that I had purchased, this morning. It was in my inbox when I came to work. I asked her how much I owed her for it....havent heard back yet. I am assuming that since I aplogized for not understanding the Copyright rules that she may have "gifted" it to me. The PRCA photographer, in which I bought the picture, is only charging me $10 for that picture's digital rights so that I can use it in future Facebook posts.
I think that maybe, going forward, when you get online or at a race and you buy a picture....there should be some sort of Copyright disclosure or something at informs people like me...that arent Copyright experts...what I can and cant do with that picture. I am not a big fan of having to pay for a picture of myself...since years ago modeling...I would have charged them to photograph me ahahahah...boy it sucks getting old! |

I should be given that photo on a CD so that I can then take it to Wal-mart or any other photo store and make as many "pictures" as I like. So in that case shouldn't the digital rights be more expensive since I am essentially buying that photo and making it mine? If photographers want to play the whole you need to buy the "rights" to this photo before posting, shouldn't they then explain how that works. If I have to buy multiple forms of my photo, digital, physical, holographic, ect, I should be then given a CD of that photo so that I can then make as many copies as I want since it is then MY photo. The logic behind some of this is questionable.
We are spoiled here with a fantastic photographer that doesn't ask much other than his watermarked pictures to not be screenshot. They say "If view on Facebook (and etc) this photo is STOLEN" across the middle of the image. Sometimes it sucks for previewing your photos, but the thieves are the ones who ruined it for the rest of us. I'd rather have a large watermark than see a photographer that is so good to us up here be taken advantage of.
Anyway, with all that said - I believe he charges $20 for Digital Download - this is Hi-Res and you can use it for printing if you so wish. He also offers digital downloads for $5. These are Low-Res and are used for your social media stuff. Of course you can buy whatever size print you want for $x.xx too. I think the way he offers it is a good way to avoid all the confusion. I swear some photographers set themselves up for headaches.
If a photographer is going to make me buy a $20 print + a $20 digital download just so I can put that same picture up on facebook, to heck with them. Sounds like in the end they will be losing money. |

Honestly there are some photographers that are really good about this! You buy a $40-$60 photo from them and they are good with you using it!
I think if they aren't I just won't use them for any of my events nor will I purchase photos from them! It does not cost them hardly anything to take photos (once their cameras are paid for), and charging us $60 for a copy seems a bit extreme to me and it is definitely not worth it for a photo but if I do buy it I better darn well be able to use it where I want.

So get off your high horse.
Almost every other person on here has also agreed with me as well that what some of the photographers charge us AROUND HERE is extreme!! I am NOT talking about the ones that have reasonable prices! I am talking about the ones that are charging outrageous prices, $60 a digital copy!

        Location: Carpenter, WY | I really can see both sides of the argument, but on a personal level I used to take alot of pics at CFD and post them on here just to share my experience with everyone. I'm no pro photographer, but I'd see the pics ALL over the place (FB, websites) and after a couple of years it kind of ticked me off. I just quit posting the pics on here altogether. All anyone would have done is just asked to use them and given me the credit and I would have been more than happy to share and given the photo to them . I'm even still seeing them on a few of the pro girls avatars on FB Maybe to those who are offended by the cost of the pic, the courtesys asked for, or the copyright rules you could just give your personal camera to a friend and have them take your pic and you wouldnt have to worry about the cost or laws??

There's more to it than just the time spent taking the photos sweet cheeks. Add in the time setting up the flashes, the cameras, all of the other equipment, the computers, etc. THEN taking pictures for hours upon hours. Then editing and uploading for hours upon hours. It adds up. So yes, all that money they charge is well worth it.
Spend it or don't. But don't complain about it if you haven't the slightest clue the work that goes into it.
And most photographers have day jobs during the week. They use their vacation time to go shoot big shows on the weekends. They usually enjoy it until they have to defend themselves and end up losing God knows how much revenue from people STEALING because they screenshot instead of just buying the digital image with all the rights to it. |

So are you saying they work harder than the rest of us?! What about how hard I worked to care for my horse, get him in shape, hours I worked at my job to afford my horse, feed vet bills, truck and trailer, gas, maintenance on the truck and trailer, etc.? I don't mind paying for my pictures, but I do take acception to them using them without my permission but throwing a hissy if I use the picture I paid for for advertising or promotion purposes or for putting it up on my Facebook page. If I buy the picture I should be able to use it as I see fit, same as the photographer does. And if I don't want my picture taken, I should have that right of refusal, too. I have a friend that does reining and at some shows she HAD to pay a photographers fee and it didn't matter if she wanted her picture taken or not. She had to pay that feè to show. That is BS! |

I just wanted to say that I didint know that I was STEALING....I thought after I bought the picture it was mine..I didnt know there was even such a thing as "Digital rights" or whatever...I have photographer friends who send me my pictures, with the watermarks, so that I can pick which I want without having to go search through hundreds of pics on the website...and then I buy the one I want.......and usually share it to Facebook until my phyisical photo comes in the mail. I DIDNT KNOW>>>>people who do not work with Copyrights HAVE TO REASON TO KNOW....until they are accused of stealing that is....so now that I know the difference I will be sure to purchase the digital if I want to post it on Facebook.
I just thought I would be clear about the fact that I didnt screenshot anything and not buy the photo. I bought it...I thought it was mine...and I wanted to post it asap because I was excited to take a good pic that weekend or whatever...meant no harm in it at all....JUST DIDNT KNOW THE RULES. NOT EVERYONE IS DOING IT TO STEAL.

Omg. This isn't a battle of who works harder. But to say someone doesn't deserve to be paid for their work is BS.
If you don't want your photo taken, don't go to a show where there's a photographer! A photographer has rights to whatever photo they take, no matter the subject. If they are invited, especially if they pay a vendor fee, any photo they take is their property to do with as they please. |

I just wanted to say that I didint know that I was STEALING....I thought after I bought the picture it was mine..I didnt know there was even such a thing as "Digital rights" or whatever...I have photographer friends who send me my pictures, with the watermarks, so that I can pick which I want without having to go search through hundreds of pics on the website...and then I buy the one I want.......and usually share it to Facebook until my phyisical photo comes in the mail. I DIDNT KNOW>>>>people who do not work with Copyrights HAVE TO REASON TO KNOW....until they are accused of stealing that is....so now that I know the difference I will be sure to purchase the digital if I want to post it on Facebook.

Most of the time if you bought the hard copy of the photo, you can scan it or take a crappy low res phone picture and post it to Facebook all you want to and most won't care. That's not a huge deal. You paid for it. And you can't reproduce quality prints with a scanned image like that.
It's the screen shots that are the big deal to me. When people get around paying anything. Or they buy a hard copy but still choose to screen shot the preview online. That is still stealing! You do not own every copy of that photo! Only the one you purchased. That's it.
When you purchase the digital copy, you get a copy of a release that lets you take that photo to a printer and get it made into prints. Usually it's not a high res copy so you won't get a 16x20 canvas but you can probably get that 8x10 you wanted but didn't want to buy at the show.
Every photographer is different though and some are pickier than others. |

Add in the time setting up the flashes, the cameras, all of the other equipment, the computers, etc. THEN taking pictures for hours upon hours. Then editing and uploading for hours upon hours. It adds up. So yes, all that money they charge is well worth it. Spend it or don't. But don't complain about it if you haven't the slightest clue the work that goes into it. And most photographers have day jobs during the week. They use their vacation time to go shoot big shows on the weekends. They usually enjoy it until they have to defend themselves and end up losing God knows how much revenue from people STEALING because they screenshot instead of just buying the digital image with all the rights to it. Yeah, this photographer gifted me this, and I thought that was nice. I was not so nice to her originally as she was telling me the photo was stolen and to take it off my wall. I didnt realize she meant the digital photo was "stolen" lol I screen shotted her my receipt for the picture not realizing there was even a difference.
I will tell you that I still dont really see the difference...to me its the same picture...whether I scan it or dont....and by the way, I can scan the original on my scanner here at work...and it looks just as good. So to say that they dont mind me scanning the picture and using it, or sharing it with the watermark...which esentially promotes their business...seem silly. Its the same picture...one of them promotes them, one of them i can scan, and one of them is "gifted" to me most of the time if I buy the physical photo. But i am not a photographer so to me its all the same thing.
From now on, I will buy the digital...which is cheaper any way...and I will scan it and print it on photo paper and throw it in a scrap book. I dont know what I would do with a million prints of the same photo honestly, its just for personal sentimental value that I even have a physical copy. I usually buy one even if a 4x6 to support the photographer at the race as a "thank you" anyway. Unfortunately that means that instead of buying the $40 photo...I am going to buy the digital for 1/4 of the price...
by the way..someone just pm'd me asking which photographer took that photo...and had it had the watermark on there...they'd have known. I will do it the right way from now on...if that means the photographer makes less money then I guess as long as theyre happy and I followed the rules that is all that matters to me. From now on I will buy the digital as my "thank you" and print it out for my personal book. 10$ sounds better than $40 any day of the week. |

Listen up “sweet cheeks” this thread is about people who had PURCHASED photos (not about those who steal them) and was called out for STEALING ….. that is just a big pile of bull sh*t anyway YOU want to spin it….. And here is a clue for you…. MANY photographers charge reasonable prices and seem to be making money without GOUGING their “subjects”. They need to remember that without those competitors…… your “photographer” would be taking pictures of BARE GROUND and selling NOTHING. |

I actually have 2 very good friends that are photographers that 100% agree with me that some photographers are over charging and they shouldn't be charging that much. So get off your high horse. Almost every other person on here has also agreed with me as well that what some of the photographers charge us AROUND HERE is extreme!! I am NOT talking about the ones that have reasonable prices! I am talking about the ones that are charging outrageous prices, $60 a digital copy! Oh and most of the time they're also charged a vendor fee of they're there for the weekend. So they're also trying to cover that on top of the other costs of just getting there and spending hours uploading and editing and everything else. You have no idea the hours upon hours of behind the scenes stuff that goes on.
Don't be so sure that "most" of them are paying a vendor fee". In my part of the world, as a producer of many races, they do not pay a vendore fee, but rather I am the one who has to provide them with lodging. And there are several that also require you pay mileage for them as well. I absolutely refuse to hire any of them that require mileage. And I really don't like having to provide lodging either but if I didn't I would not have a quality photographer. I have to consider it a cost of producing a race. So yes they have a lot of hours, money, and equipment investment. But that is a cost of doing their business, just like having to pay their lodging is a cost of me doing business and a service I provide to those who enter. We could take this a step further...since I paid for their room, provided them with exclusive rights to photograph my event, then maybe all of us a producers using their services need to get a percentage of every photo they sell from our events because after all if it wasn't for my hard work, long hours, money and equipment I have invested producing my event, they would not have the opportunity to be selling their pictures. Seems kind of crazy huh! I will also not ever hire a photographer that requires me to have my contestants pay a mandatory photographer or videographer fee or requires me to pay a per contestant fee to them, nor will I enter a race that demands that of me as a contestant.
As for purchasing rights to a photo they are not always cheap. We bought a picture of my kid at the NHSRA Finals a few years ago. Very nice picture from a very well known professional photographer who takes pictures at a lot of high profile events. I had a local business ask to use the picture for a project they were doing, so I contacted the photographer asking for permission and they would be noted as the photographer and get the advertisement for it. The reply I received "my fee is $1000 if you would like to purchase the rights to that photo". Um...no thank you. |

And that right there is what I am talking about! That is completely unreasonable! Also like ropenrun said we usually have to pay these photographers to come to our events and then pay for the $60 digital photos! |

Apparently before I say this I need to preface it with saying I am NOT trying to say anyone works harder than anyone else, BUT- competitors do NOT take into account that it's very common for a photographer to be in the sun the entire day, because that may be the best place to shoot from. The photographer may not eat lunch, or may have to wait forever to go to the bathroom, because heaven forbid you miss a run (that's sure to be the one person who comes *****ing to you later that "YOU DIDN'T GET A PICTURE OF ME!). As was mentioned, most of us have another job, and may use vacation to go shoot a big event. I know I pay my own fuel, and at least for a barrel race I've never had a producer pay for so much as my lunch. After spending that day in the sun, you get to go home, spend hours downloading, organizing, then uploading to a website. (while people bug you about why it's taking so long... the same people who don't usually PAY for anything later) Sure enough, every barrel race, I would start seeing screenshotted versions of my photos showing up on Facebook right away.
I've tried to explain it this way... if someone spent all day making something, say- a headstall. They have worked to perfect their craft, bought their equipment, and put the time into making something, and produced a product... are you going to just walk up and take it? That's what you're doing when you steal a photograph. It doesn't matter if the photo is of you. The LAW doesn't care. That photographer has spent time learning what they do, thousands of dollars in equipment, etc. It's illegal and just disrespectful.
For the record, I won't shoot barrel races anymore because of how bad it got. I do a couple bigger horse shows a year where I haven't had any problems, and then some portrait shoots. It's not worth it. |

It's not gouging. A print and a digital file are separate products. So you buy the headstall, you can grab some reins on your way out?
My website offers the option of purchasing a digital file for internet use. This is not the full-res file for printing (that one costs more because it prevents me from making any future money off that photograph). At larger shows, I usually offer a deal such as including the internet-use digital file with purchase of an 8x10, or something like that. The photographer should be clear, but the customer should not feel entitled to steal. It is stealing. The file is a PRODUCT and takes away from future profit from the photographer. I can still sell prints off something I shot years ago, but I won't if the person is illegally making their own copies. |

Now have transitioned to posting a handful of previews on fb (with watermarks) and the rest on smugmug (with watermarks). I will sell as hard copies or digital, but I prefer digital as it's easier for me and the customer as 90% will use for posting on social media or what not. I charge $15 and once you have the picture you can use it for what ever you choose. I do not mind pictures of hard copies but it does make the picture look downgraded and I would rather you just let me know and I will send a digital copy for free if you already purchased a hard copy. I have my pictures right-click protected on smug mug but of course that doesn't stop screen shots from being taken. Social media has been a huge promoter but also yes a big problem for photographers. 9 times out of 10 it isnt the issue of you buying the photo, it is normally the people that never buy anything from the photographer. They go on the website where the photos are for sale and steal them and post them on FB. Those photographers sit there for the entire show and take photos and I dont blame them at ALL for not wanting their photos stolen. It has always amazed me when you come home from a show and see photos on FB that have STOLEN written across them. How hard is it to pay the $3.00 for a digital copy? I am yet to meet a photographer that wont throw a digital copy in for free if you buy a hard copy of the photo. Most of them are wonderful to work with and get tired of people stealing their photos. They deserve to get paid just like anyone else. However Motivated if you already paid for the photo, I can't imagine they wouldnt be able to work with you on a digitial copy.
Who just charges $3 for the digital copy??? I've never gotten off that cheap, and I, too, went through what the OP did....being called a thief, etc....when I didn't know....and that particular photographer charges from $50 to $150 for the digital rights depending on the picture and where it was taken and how many there are. There is one photographer that comes to local events that only charges $5, but that's the cheapest I've EVER encountered and I try to buy as many as possible from him. |

The photographer should be clear, but the customer should not feel entitled to steal. It is stealing. The file is a PRODUCT and takes away from future profit from the photographer. I can still sell prints off something I shot years ago, but I won't if the person is illegally making their own copies.

They go on the website where the photos are for sale and steal them and post them on FB. Those photographers sit there for the entire show and take photos and I dont blame them at ALL for not wanting their photos stolen. It has always amazed me when you come home from a show and see photos on FB that have STOLEN written across them. How hard is it to pay the $3.00 for a digital copy? I am yet to meet a photographer that wont throw a digital copy in for free if you buy a hard copy of the photo. Most of them are wonderful to work with and get tired of people stealing their photos. They deserve to get paid just like anyone else. However Motivated if you already paid for the photo, I can't imagine they wouldnt be able to work with you on a digitial copy. Who just charges $3 for the digital copy??? I've never gotten off that cheap, and I, too, went through what the OP did....being called a thief, etc....when I didn't know....and that particular photographer charges from $50 to $150 for the digital rights depending on the picture and where it was taken and how many there are. There is one photographer that comes to local events that only charges $5, but that's the cheapest I've EVER encountered and I try to buy as many as possible from him.
This guy charges $3 for a low res digital photo. He's also great at his job and a very good guy :)

         Location: TN | If I buy a picture I WILL do what I want with it. Guess I need to stick to buying pictures from the guys I have in the past cuz they are FB friends. I would think when some one posts their pictures on FB it's good advertisment for their work and a reminder to every one else at the same show to get their pictures. If I see posted pictures of friends it reminds me to go look at mine. I do think it's very tacky to post pictures with the marks across the image, makes the individual look cheap. Definetly would not do that out of respect for the photographer.

| After unintentionlly stealing their photo, it being brought to my attention, me apologizing for being an ass about them accusing me of stealing...which technically, I guess I did. They sent me my digital in my email...when I asked how much I owed them and this was the response I got. The PRCA photographer who also accused me of stealing, which technically, I guess I did....said he would send me the digital for $10. Yes, as a reminder, I had paid for both phyical copies and thought that I was allowed to post the watermark copy on Facebook until my pictures came in the mail. When I got them I threw them in a frame or a scrap book and never thought twice about the watermark pictures online. From now on, if the digital copy is reasonably priced, I will probably just buy it instead of the physical.

Ah but you can only turn it into a neck stocking stufferce. A photo can be reproduced digitally over and over and over again. You get much more 'value' in terms of reproducability with anything that is copyrighted, thus the difference between intellectual property and real property. You can't copyright real property as it only exists in a tangible form but intellectual property can be reproduced almost infinitely. They are different mediums and thus different laws, etc., guide them.
I have no idea why that says neck stocking stufferce. I've edited it a few times. I mean neck strap. It keeps correcting my edit to the neck stocking thing. Hmm.

ha! now that is funny.. My friends daughter changed the auto-correct in my phone so that every time I type HOME it changes to Strip Club. There has been so many time that I have sent a text and not noticed and it says something like, Taking the kids to the strip club, meet you there... I haven't figured out how to remove it!! |

But here is one thing that bothers me. Since I enter barrel races or am in any public venue or place, ANYBODY has a right to take my picture? And do what THEY want with it? That just doesn't seem right to me.
Just sayin'........ I get a little upset when friends of mine post my pic on FB without asking me. I am a rather private person and it just bothers me (even worse when they put my personal business out there, like when I lost my mare. I know their intentions re good, but it's MY business, not theirs'). |

But many people advertise on their facebook and/or to sell horses. They will use those photos several times for those purposes. I don't agree with charging $50 or more for a digital copy UNLESS its a high res magazine quality photo BUT asking someone to pay 5-10 for a low res photo that you can reproduce anywhere with digital rights seems perfectly reasonable to me. My mom does photography and she has never charged an arm and a leg but selling copies of a picture and selling the actual file (used to be the same way with selling you a copy or selling you the negative) are two very different things. I know we think about photographs differently but its really no different than taking someone's novel, copying it, and selling it on Amazon as an ebook. You've stolen their production and offered it forward EVEN IF you offered the book for free. People have access to the material. Its not that different from plagiarism in my classroom either. The student may get the material on the internet for free, or even pay for a paper, but at the end of the day they have taken that material (stolen it) and carried it even a step farther when they represent it as theirs, even though they get no particular financial reward for turning in a paper. If you use a copy of a scanned photo to sell a horse, you do get a financial reward and are making money second hand off the photographer's work.
Taking pictures of someone and the rights to take a picture are a whole nother kettle of fish I'm not going to crack open. But I do understand the point of buying a digital copy so you can reproduce it freely. The law wouldn't exist in the first place unless tons of people were abusing it.

| wow well i went through and read everyone of the posts. i dont know of other photographers but i am an old barrel racer and i have always tried to keep my photo prices down to were people can buy them. when you get a picture from me you are buying the printed picture. now if you go and take a picture of it for on facebook go ahead, for a digital download for on face book i charge just $4.00. how many others do that ??? and for whoever said we just work 2 days and just at the show come on over, not only are we there from the time the first horse runs till the last but our bathroom and food breaks are at every big drag which sometimes dont come near quick enough. then after the show we get everything loaded to the website and hope that they are good enough that people will want them. what gets me the most are the ones that as soon as i get them loaded on my website they are screen shooting them for on face book. and then i hear o its no big deal. well sorry but to us it is.

I can use Winblows/Paint to do away with those.... No problem.... It takes 45 seconds for me and I'm NOT very good!!!! I'm not even a hacker and I can remove all proof that it's your photo... |
