Pretty sure if your not the brand inspector or the indiviual this is addressed to or the parties involved, you did not obtain this legally. You would need a gramma request to get this legally where it is a civil matter.

any court decision can be viewed legally by the public.

edited to add...yo will usually need credentials to view Federal verdicts...however most county/state documents can be viewed by anyone anytime...

BTW Angel Wings, if you would like to see all documents pertaining to this case which have been filed, go to the courts website for the venue and look up the civil action number. You should be able to view everything, including the Complaint, the answers, ect...

This statement got me to reminiscing.....a trip down memory lane. Reminded me of a hilarious scene in "Animal House":

Boon: Watch it....they're serious this time!
Otter: Take it easy, I'm pre-law.
Boon: I thought you were pre-med.
Otter: What's the difference?

Thought a little levity might be in order.

Looks to me like a simple contract dispute.

Offer and Acceptance/Rejection, Terms, Mutual Understanding (which is usually where disputes occur) and did both parties comply, Breach, Excuse, etc. You'll learn all of this in your contracts course and there will be plenty of cases to look at.

Not entirely true.....depends on the state.....many states actually post civil court documents online......unless those procedures are sealed with a non-disclosure agreement.

You can get online and get MANY civil court documents, as they are public record.  It just depends on whether that particular court reports them.

Even though several threads have been deleted, I would bet that a civil thread that simply provided sworn documents with facts would be allowed.  The administrators appear to support truth.  They don't like innuendo.

I wish more kids today would take your approach and actually read sworn documents to form their opinions.  Today everyone reads the first article that Google pulls up and considers that their fact checking.

I'm glad to see that I'm not the only one....I don't like to be pompous, but I can't believe most people don't know that court papers are often public knowledge. Most news outlets no longer do what they're supposed to do anymore (you know, REPORT NEWS), which often leads to incorrect information being spread around.

Angel Wings - 2015-10-28 10:04 AM If you have a copy of the judges decision from the ruling of Jacobs vs Loflin please I would like to see it.  Thank you.  This is not a bash post.  I just want to see for myself how the judge ruled as I studying for my LSATS.
So...somebody wanna tell me what's going on with this?

Their was a dispute over the ownership of Movin between Christy Loflin and another party.  The courts have ruled that the other party is the sole legal owner of Movin.

It's not quite that simple.  All jurisdictions aren't equal in sealing documents.  Some will seal with little scrutiny.  Other wont.

To the OP you can get the records from Douglas County Court by filling out the request form on line and they will send it to you. Note if not sealed by the party's and the court. The case is Jacobs vs. Loflin District Court, Douglas County Colorado. Case number 2015cv30078

OK, so I hope this one doesn't get the thread deleted LOL

MOST, a big portion of, the court documents have been available and part of public record, including the alleged current appraised value. various motions, the basis of the suit etc.
There are some that have been marked confidential that are not available.

I do not believe the court has the formal ruling/paper entered yet. There were other parts of the case that were settled before they actually went to court.

yes, some documents are confidential. Similar to a child support motion, they have certain documents (usually related to assetts/income) that are not available to the public.

I guess I live under a rock...I always thought it was her horse....so I guess she was riding her for someone else or leasing her?...in any case, does this mean they will take the mare away from her?...if so, I think that's sad...she rides her good and has to have a bond with her....

I think that many of the 'top' competitors ride horses owned by other people. Since the true owners never seem to get mentioned, most people assume the person doing the riding is the owner. I think that is a crying shame that these owners don't get more mention when these people are winning on their horses, and especially the owners that are paying some of the tab going down the road.
I don't have a problem with it, just wish some of the credit could spill over to the people in the background.

He has been listed as owner for a bit now. Riding someone else's horse will never last forever. Doesn't make sense when one thinks it will even with a verbal contract that it will. People and circumstances change all the time. I feel bad for her loss, but I can't imagine one thinking it would never end.

Wow that is crazy! Makes you wonder what horses that have won more, such as stingray, would appraise for.

One of the motions filed was that, if Mr. J was found to be the owner, he owed her a considerable amount for the increase in value of the horse--for "training". SO-she had an appraisal done--so that could make a difference I bet on that dollar amount. A horse is worth what someone will pay for it.

As far as publishing the publicly available documents--there are TONS--way too much. I am not sure the written judges decision is available yet--usually takes a week or so to get them up, historically. I'm not sure how much of the out of court settlement documentation will be available to the public--will know in a week or two I guess.

nousername - 2015-10-29 12:18 AM OK, so I hope this one doesn't get the thread deleted LOL MOST, a big portion of, the court documents have been available and part of public record, including the alleged current appraised value. various motions, the basis of the suit etc. There are some that have been marked confidential that are not available. I do not believe the court has the formal ruling/paper entered yet. There were other parts of the case that were settled before they actually went to court.

So what is the appraised value??

$700K

So, this is beginning to sound like a familiar MO.

It will be interesting to see the courts reaction to that claim.  If I were Mr. J., I would argue that her winnings were more that equitable renumeration for the "training".

It probably will take a few days before the final order or judgment is approved by both parties (with them hammering out language details) and getting the judge's approval before it's officially signed and filed with the clerk.  I know if I were drafting this one, I'd want to look it over a bit and make sure things read right before sending it to the other side for their consideration.  There's also the possibility (at least in theory) that one side might wish to appeal a portion of the ruling itself so it's not a guaranteed end to it all.

The judge did not rule on that. My understanding is all of that was hashed out in the settlement meeting before they actually went to court. The judge issued a bench ruling on motion by Mr J for immediate ownership and possession of Movin. The rest of the mess was settled pre-court via negotiation between parties and their attorneys.
There were actually 5 horses named in the suit. As far as I know, there was no exchange of cash.
She did get to keep 2 mares, the foals she posted pics of, and a pretty nice horse named "Flashy French Kirk".

I hear the argument, "the horse is worth more because I rode it", all the time.  What the courts think about that argument in different senarios would be interesting to read.

Yeah! I've noticed that even the calf horses get a mention if they are owned by someone else. But then again CBS has an analyst who is more in the loop. (no pun intended)

Not that I know of .... even if they are part of a personal business, you don't pay taxes on every asset of the business ... You don't pay taxes on every cow, only what she produces IF you sell it.  If you don't sell it, no income so no taxes. That's my understanding.

I guess it depends on the state. I worked for a dairy farmer that moved out of California because they taxed him quarterly on everything. The cows, grain bins, grain IN the bins, home, barn, ect..ect

Livestock DOES get taxed in many states as a yearly "personal property tax"....Arkansas & MIssouri are two that I do know that tax them, along with trailers, tractors, etc.....but on the other hand property tax is really low.

Do horses count as personal property?

Arkansas?  Really?  Huh. Never heard that.

If they are not in agreement, I would expect the owner to argue that appraisal figure. That is a nice mare but 700,000? Regardless, my heart breaks for Christy knowing she made that mare what she is. I guess she was lucky to get to ride her so many years but this is why I would never want to be competing at that level on a horse I do not own.

Big D meaning Divorce?

I was surprised when I read in an earlier post there was court pending, I wondered why she wasn't in the tops at alot of rodeos this summer.

Ummm.... no. I would suggest searching it on Urban Dictionary. It will have the definition.

from the Urban Dictionary defenition
http://www.urbandictionary.com/define.php?term=Big+DBig D

1) Dallas, Texas
2) divorce
I'm goin' through the Big D and I don't mean Dallas.
-- Mark Chesnutt, "Goin' Through the Big D"

Ok I was wrong though, says she got the D not Big D, so what does that mean

You do know there's this guy - Ryan Lovendahl - that was also very successful on the mare prior to anyone else running her?

I'm sure there are experts...."specialists", if you will, who know how to compel a judge to rule in favor of putting a horse up for auction to settle this kind of dispute. If a person just happened to be close friends with these like-minded, experienced, experts, this approach is being considered.
Of course, getting someone to buy a horse for a ridiculous sum of money is the hard part, and then you have to be able to offer something in return for turning that horse over to you. One must be skilled in this ancient art.
Tricky business.

Serious question....is it possible that a judge could order the horse be put up for auction?

My understanding is no, the sole legal ownership is Mr. J's. There was never a contract, paper, written agreement etc. to contest---
She wanted to claim it had been given as a gift (The horse was already six figures when they bought her after Ryan Lovendahl futuried her).
I'm sure if there were 5 different people doing an appraisal, you'd get 5 different figures/opinions.

I think we pay $25 a horse on ours. I'm always a smart *** and say I'm going to leave off a horse and see if they drive around counting horses in people's pastures

I can confidently say they don't drive around counting horses...at least not where I live.

They drive around here regularly and take photos. Although, I think more to monitor property improvements than livestock.
The first year I filed I listed everything, but noticed in the years since, the animals and old tractor are no longer listed. I'm not sure why and I didn't ask...

That depends on where you live.  W pay taxes on every head of livestock (cows, horses, chickens( whether they are part of a business or not.   And they catch on to those who don't pay taxes on horses via getting a brand inspection.  There are a couple other ways they check to know if per capita taxes are being paid as well.

Why? So the group of hyena's that frequent these types of threads can come and try to rip my throat out like they usually do? No thanks. The OP asked for documents and I don't have any so my info could be argued as not being factual.

I'm sure the real facts will eventually come out without my help.

Can't blame me for asking. Like anywhere on the Internet, folks are gossiping like crazy about this. I think most take what they read with a grain of salt.

Im sorry that you feel there would be backlash for saying something posted here is not true. That's a shame.

One of my favorite quotes. I agree that eventually the truth will come out. It always does. I do think it is natural for people to be curious about the legal circumstances and the destination of this great mare. There is a lot that can be learned from this situation.

I wasn't blaming you for asking and I can certainly understand people being interested in what's going on. But if what I was told isn't in the court documents for the public, then I don't feel it's my place to fill in the blanks. I already know what would happen next. Someone wouldn't be able to find it with Google so they'd just come back with my facts not being able to be justified....blah, blah, blah. The next thing you know I'm in the middle of the feeding frenzy as the main course. Like I said...I think I'll pass on that.

Rick/Jordan (whatever one of you has this login), you know exactly who I am. If not, I'm sure you can run back to the Fallout Shelter and ask Norma.

I'm not sure I appreciate your implied innuendo. I happen to live in the same state that this mess is being tried in. The barrel racing world is small here. Of course everyone knows what's going on. I knew it was about to become an issue back in June/July.

Although I would love to know the facts, I understand why SKM is not going to spill the beans. I have watched certain people rip her to shreds for telling the facts/truth on this site. One time for sure it was just simply letting us know what was happening at a big rodeo that she was watching. I love BHW for all I learned - feeding, training and horse care- but we sure can eat our own at the drop of a hat. I know she doesn't need me to stick up for her, but it's my way of thanking her for her insightful and educational posts. There are several ladies on here that I really respect for their knowledge and willingness to share that knowledge and SKM is one of those.

No worries, I wasn't upset. Just curious!

I do look forward to see Movin running again. I'm sure it won't be long. She's a fabulous mare.

I wonder how many people have approached Mr. Jacobs wanting to buy Movin? I know that if I had the money and wanted to make the NFR, she's the one I would want.

I was told last night that Movin was already sold. I posted it a couple times, but it was erased. I guess that means only absolute verifiable facts are now allowed.
