edited to add...yo will usually need credentials to view Federal verdicts...however most county/state documents can be viewed by anyone anytime...
BTW Angel Wings, if you would like to see all documents pertaining to this case which have been filed, go to the courts website for the venue and look up the civil action number. You should be able to view everything, including the Complaint, the answers, ect...

Looks to me like a simple contract dispute.
Offer and Acceptance/Rejection, Terms, Mutual Understanding (which is usually where disputes occur) and did both parties comply, Breach, Excuse, etc. You'll learn all of this in your contracts course and there will be plenty of cases to look at. |

You can get online and get MANY civil court documents, as they are public record. It just depends on whether that particular court reports them. |

I'm glad to see that I'm not the only one....I don't like to be pompous, but I can't believe most people don't know that court papers are often public knowledge. Most news outlets no longer do what they're supposed to do anymore (you know, REPORT NEWS), which often leads to incorrect information being spread around.

Their was a dispute over the ownership of Movin between Christy Loflin and another party. The courts have ruled that the other party is the sole legal owner of Movin. |

Just an FYI Civil court documents are public and anyone can request them. You just have to contact the Court to request them and pay a copy fee. And I know this because I work for the Court. |

It's not quite that simple. All jurisdictions aren't equal in sealing documents. Some will seal with little scrutiny. Other wont. |

There are some that have been marked confidential that are not available.
I do not believe the court has the formal ruling/paper entered yet. There were other parts of the case that were settled before they actually went to court.

yes, some documents are confidential. Similar to a child support motion, they have certain documents (usually related to assetts/income) that are not available to the public. |

| I think that many of the 'top' competitors ride horses owned by other people. Since the true owners never seem to get mentioned, most people assume the person doing the riding is the owner. I think that is a crying shame that these owners don't get more mention when these people are winning on their horses, and especially the owners that are paying some of the tab going down the road.
I don't have a problem with it, just wish some of the credit could spill over to the people in the background.

| He has been listed as owner for a bit now. Riding someone else's horse will never last forever. Doesn't make sense when one thinks it will even with a verbal contract that it will. People and circumstances change all the time. I feel bad for her loss, but I can't imagine one thinking it would never end.

One of the motions filed was that, if Mr. J was found to be the owner, he owed her a considerable amount for the increase in value of the horse--for "training". SO-she had an appraisal done--so that could make a difference I bet on that dollar amount. A horse is worth what someone will pay for it.
As far as publishing the publicly available documents--there are TONS--way too much. I am not sure the written judges decision is available yet--usually takes a week or so to get them up, historically. I'm not sure how much of the out of court settlement documentation will be available to the public--will know in a week or two I guess.

It probably will take a few days before the final order or judgment is approved by both parties (with them hammering out language details) and getting the judge's approval before it's officially signed and filed with the clerk. I know if I were drafting this one, I'd want to look it over a bit and make sure things read right before sending it to the other side for their consideration. There's also the possibility (at least in theory) that one side might wish to appeal a portion of the ruling itself so it's not a guaranteed end to it all. |

The judge did not rule on that. My understanding is all of that was hashed out in the settlement meeting before they actually went to court. The judge issued a bench ruling on motion by Mr J for immediate ownership and possession of Movin. The rest of the mess was settled pre-court via negotiation between parties and their attorneys.
There were actually 5 horses named in the suit. As far as I know, there was no exchange of cash.
She did get to keep 2 mares, the foals she posted pics of, and a pretty nice horse named "Flashy French Kirk". |

Not that I know of .... even if they are part of a personal business, you don't pay taxes on every asset of the business ... You don't pay taxes on every cow, only what she produces IF you sell it. If you don't sell it, no income so no taxes. That's my understanding. |

Livestock DOES get taxed in many states as a yearly "personal property tax"....Arkansas & MIssouri are two that I do know that tax them, along with trailers, tractors, etc.....but on the other hand property tax is really low. |

Regardless, my heart breaks for Christy knowing she made that mare what she is. I guess she was lucky to get to ride her so many years but this is why I would never want to be competing at that level on a horse I do not own. |

If a person just happened to be close friends with these like-minded, experienced, experts, this approach is being considered.
Of course, getting someone to buy a horse for a ridiculous sum of money is the hard part, and then you have to be able to offer something in return for turning that horse over to you. One must be skilled in this ancient art.

My understanding is no, the sole legal ownership is Mr. J's. There was never a contract, paper, written agreement etc. to contest---
She wanted to claim it had been given as a gift (The horse was already six figures when they bought her after Ryan Lovendahl futuried her).
I'm sure if there were 5 different people doing an appraisal, you'd get 5 different figures/opinions. |

They drive around here regularly and take photos. Although, I think more to monitor property improvements than livestock.
The first year I filed I listed everything, but noticed in the years since, the animals and old tractor are no longer listed. I'm not sure why and I didn't ask... |

W pay taxes on every head of livestock (cows, horses, chickens( whether they are part of a business or not. And they catch on to those who don't pay taxes on horses via getting a brand inspection. There are a couple other ways they check to know if per capita taxes are being paid as well.

| Although I would love to know the facts, I understand why SKM is not going to spill the beans. I have watched certain people rip her to shreds for telling the facts/truth on this site. One time for sure it was just simply letting us know what was happening at a big rodeo that she was watching. I love BHW for all I learned - feeding, training and horse care- but we sure can eat our own at the drop of a hat. I know she doesn't need me to stick up for her, but it's my way of thanking her for her insightful and educational posts. There are several ladies on here that I really respect for their knowledge and willingness to share that knowledge and SKM is one of those. |
