| my lawyer is out of town got a notice in the mail from court that a guy i have a judgement on is filing 13.
so thats why i am asking till he gets back anything know about 13
dude owes me 6600 in back house payment 2500 property taxes i had to pay plus lawyer 3700 pluse he tore the house up another 29000
i foreclosed on him 6.1 did the hearing conformation of sale am i gonna be out can he just walk away

Location: That part of Texas | Maybe/maybe not. It depends on a lot things, including things that you probably won't know or have an answer to until your attorney gets back in the office and can actually look at the paperwork filed, things claimed and other details. |

| Chapter 13 will stall the sale date indefinately. We have had some do it to us, they were able to live in the house without making payments for 3 years. You will now have to wait for the bankruptsy to discharge or be kickout. If your debt is unsecured you will not get anything if it is discharged.

no we have already foreclosed he left the house volunairly in july went back got confirmation of sale so he has gone to north ga |

Well heck how can someone like this then file Chapter 13 if they dont own a business, da* gutless people, he owes you money so he takes off, peice of dog doodo.. Sorry that this is happening to you, hope he has to pay you every penny he owes you back.. |

| i don/t know but he makes a helll of lot more than i do the house was trashed you should not be able to file bankcucy u incurre debt you should work it out |

| I thought under chapter 13 the debtor has a payment plan and that anyone who he owes a debt to can file a claim against their bankruptcy and receive partial payments under their plan. You won't get the full balance owed but I think you will get something.
There should be some explanation in the letter that you received on how to proceed if they owe you money, however, I would definitely get in touch with your attorney as soon as possible. |

| i don/t know lucky for me its a small town as my name wrong address otherwise i would not have know
i call court the lady said he put down that he only owed me 1568 .oo
but back house payment lawyers back property taxes plus judgement on house more like 14,000 pluse judgement on house
