I purchased a used Rogue from a very large dealer in a town close to where i live. I bought from my husbands cousin thinking i would get a good deal. The car has 97k miles on it but he sweared he had his mechanic check it over and it was in excelent shape. I have never owned a car that i finance but i did this one. So brought the car home drove it about 90 miles to a horse show and transmission went out on the car. I did purchase it AS Is but bought an extended warranty on it. Now the dealer is saying they disclosed all that was wrong with it and i have to pay for the transmission. ( They did not tell me about the transmission)  Do i have any legal right to get another car or get my money back. The car is at the dealers right now they want to fix it but me pay for it which will be another 3000 dollars. The insurance says it is their fault and the dealer owes me the  repairs at no cost. In the mean time i have nothing to drive and a job to go to. What can i do?

I’d be tempted to fight it if there is nothing in writing.

 

But, that is also why I always have MY mechanic look at all our vehicles before we buy them.  Kind of like having your own vet do a vet check.

 

And sometimes - luck just sucks.  I would think a transmission would show some signs of impending failure, but when we bought our current LQ the toilet failed on the first trip we took - the water wouldn’t stop running and it almost flooded the trailer.  Research showed it was a known issue with that model and we flushed the unlucky 1,647 flush where the part failed.

 

If insurance will help you push on them, push on them a little.

I'm only quoting OhMax because we just had a transmission go out on a car that showed NO signs of it failing, it simply just quit...90 miles from home...in the middle of a busy intersection. Anymore it is mostly the electronics of the transmission that go bad, not the actual mechanical parts. Twice we have had this happen in the last year (we have a car dealership).

 

If you purchased an extended warranty, the warranty SHOULD cover it. However, did you buy an extended warranty or a service contract? There is a difference. The As-Is No Warranty thing is a federal law, so you will likely have to rely on whoever the extended warranty is through to help you out if they will. Otherwise it will likely be out of pocket.

I would also add, if they will not do any of it under warranty - you have every right to take the car somewhere else to be fixed and may find a better deal to do so.

My son has a Nissan Sentry that he bought new that had transmission issues about a year ago.  We bit the bullet and replaced it for about $3000 but then he talked to some other people that told him to Google Nissan Sentry transmission problem and he found out it was NOT the transmission but a cheap fix.  I wish he were here but I would try Google before you spend the bucks.

If you do have to pay for it out of your own pocket I would take the car to your own mechanic if you have one that you trust and let them look it over, I dont trust car dealerships much, it could be something very simple but the dealership wont amit it and sometimes and they will still charge you for something that did not need fixing. So please if you do have a mechanic take the car to him..

Follow directions to look for recalls ..

Notify your car loan holder and have your title, warranty, sales slip, sale date/mileage, failure date/mileage and written estimation of repairs and ask if they can help with the car jocky dealer or actual new dealership of flipping this car for another etc etc ...  Ask them for the maximum they would loan you for a new car ... down payment, term, interest rate and payment .. and write it down or have them send an email as being pre approved for xxxx  $$$'s.

Ask your insurance if they can track where this car was sold new, used sales locations and see if the locations and dates match up with flooding in those locations and if they can find any records on it where it some insurance company paid the owner flood value for it ....  there were millions of these flooded cars all the way back to Katrina just disappeared across the USA to be resold instead of scrapped .. 

Look at NADA PRICING for your year and make of car and see how bad you got ripped off ... and be honest whether cousin or not all used car people are interested in is making a commission ..  mention this data to your lender if there is a major difference in what you paid. 

CAR FAX is about the only avenue a consumer has .. typically $35 but they have deals where they will give you 5 car searches for the one price.. since you are searching for a new car it may be a good thing.   If you are unfamiliar with CAR FAX go to ebay motors .. trucks and cars ... and search cars until you find one with the ebay history or a car fax so you know how they are formatted with wrecks, number of owners, condition ratings, auctions and service records etc etc ... 

If this is an actual new car dealership go to the general manager and see if you can flip the down payment you made on something else or even on the least expensive $10-12,000 new car they have push him on you turning to twitter for help with dealership name etc etc ... 

Most times people haven't figured the 60-72 month payments, lower interest rate that the same payment or even less would put them in a new car rather than buying a used one with higher interest shorter terms and having an unidentified problem as the reason the previous owner got rid of it ... and then some cars are just lemons ..  GOOD LUCK .. get organized and go on the attack and take someone with you ....

I'm not sure about where you live, but here in okla, we have a lemon law which includes buying used cars. With the lemon law you can take it back if the car falls apart with in a certain amount of time. Personally, I would be talking to an attorney & I'd let the dealer know you'll be talking to an attorney. My parents always taught us, never do buisness with family or friends.
