Well, here's the first thing that needs to happen. He needs to sue the PANTS off Covington & Burling, who literally screwed this patriot every way they could. They conspired with the government to destroy him. They already have all the proof. Then he needs to go after whoever else he can personally. Flynn depleted funds for defense; they threatened his son. He was forced into a corner and the only way out was with a plea; however, a new lawyer stepped up to assist him and they began proceedings to withdraw the plea. It should be scary / alarming to every American that the FBI would blatantly ignore our laws and intentionally work to set him up.

The reason we know what we know is the release of transcripts of testimony, real time notes and other papers that show how they were pulling strings to put the genie (Ovomits lack of "candor" in national matters) back in the bottle. That is proof. Just released in the last few days. Just one of many things that just don't add up. Or they do add up, just not to prove Flynn did anything except be a patriot to this country.
"The notes in question are handwritten and appear to outline the Crossfire Hurricane team’s objectives for the planned interview with Flynn at the White House, just days after the inauguration of President Trump. They are clearly initialed by then-FBI Assistant Director for the Counterintelligence Division Bill Priestap. I know Bill from our overlapping assignments in the FBI’s New York office. He is an experienced, honorable, and well-respected lawman.
But one passage fairly leaped off the page at me:
“What's our goal? Truth/Admission or to get him to lie, so we can prosecute him or get him fired? If we get him to admit to breaking the Logan Act, give facts to DOJ & have them decide. Or, if he initially lies, then we present him [redacted] & he admits it, document for DOJ, & let them decide how to address it.”
OMG he's a traitor. LOL He was also the DNI under Ovomit. Was outspoken against the Iran deal and many other policies of the Ovomit admin. He knew where all the bodies were buried and Ovomit was terrified of him. Ovomit "warned" Trump about Flynn. But Trump hired him anyway. Trump was fixin to take Ovomit's legacy down and what better person to help him?
Flynn had Top Secret and Sensitive Compartmented Intelligence clearances that if he were a threat, he sure wouldn't have had. He had JUST been investigated by the FBI and they were closing his file when Strozk made them open it again. That's when all the BS hit the fan.
The Mueller team was involved in this and blackmailed Flynn by telling him they would go after Michael Flynn Jr. whose wife just had a baby. If you don't think that threat was real, I ask you where is Manafort right now? He was convicted on a bogus "black ledger". George P spent time in jail for "lying", which he didn't do. etc. etc. etc.... ALL the people they put in jeopardy...NONE were convicted or even accused of conspiracy with the Russians. Because there was NO conspiracy with the Russians. Unless you're talking about Killary and the DNC.
Just an asside. The FISA the FBI got against Carter Page and renewed several times had no basis. Carter Page was a patriot that was working with the CIA trying to take down Russian operatives and the FBI attorney Clinesmith changed the email from the CIA to "no Carter Page was not an asset" so they could get that FISA. Fruit of the poisonous tree. Everything obtained after that falsified FISA was illegal spying. Yes SPYING!
The Ovomit admin and all his minions wanted Flynn out of the way so they could take Trump down. Because. You know. Orange Man Bad. Terminal Level TDS.

This is my third response to liberal Democrats’ efforts to take aim at the motion of the Department of Justice to dismiss the prosecution of General Michael Flynn.
Today its the turn of former acting head of DOJ’s National Security Division under Pres. Obama, Mary McCord. On Sunday McCord penned an op-ed in the New York Times in which she took to task the DOJ motion because Justice had the temerity to rely on a statement she gave to the Special Counsel’s Office (SCO) in the summer of 2017.
But before jumping into the McCord piece, let’s add a couple biographical notes to the story of Mary McCord.
She was a career prosecutor with DOJ, and spent several years in the U.S. Attorney’s Office for the District of Columbia, and National Security Division of Main Justice. When McCord left DOJ she was hired by House Intelligence Committee Chairman Adam Schiff. She was “front and center” in the whistleblower fraud run by Schiff. Michael Atkinson, the Intelligence Community Inspector General who referred the whistleblower matter to the House Intelligence Committee, was “Special Counsel” to McCord at the National Security Division.
Now let’s turn to the op-ed she wrote for the NYT, endeavoring to undermine the DOJ motion to dismiss the case against Gen. Flynn.
Recall that the basis for the DOJ’s motion to dismiss was the finding from an internal review of the work of the SCO by U.S. Attorney Jeffrey Jensen from St. Louis, that at the time of the January 24, 2017 interview of Gen. Flynn, the FBI no longer had a legitimate counterintelligence investigation of him, and the FBI never opened a criminal investigation of him connected to his telephone calls with the Russian Ambassador. Based on that factual determination, DOJ determined that there was no evidence that Gen. Flynn’s answers to the Agents questions — whether true or false — were “material” in a strictly legal sense, and “materiality” of a false representation is an element of the crime set forth in 18 U.S.C. § 1001. Without materiality, there is no crime.
McCord comes forward to challenge DOJ’s determination. First, she registers her objection to the use by DOJ of a statement she gave in mid-2017 to SCO investigators. She claims:
“[T]he report of my interview is no support for Mr. Barr’s dismissal of the Flynn case. It does not suggest that the F.B.I. had no counterintelligence reason for investigating Mr. Flynn.”
She is correct. The DOJ motion states that FBI — not her — said in writing on January 4, 2017, that it had no counterintelligence reason for continuing its investigation of Gen. Flynn. So her point that she never said that is accurate — but irrelevant.
Going on …
“[My interview] does not suggest that the F.B.I.’s interview of Mr. Flynn — which led to the false-statements charge — was unlawful or unjustified.”
She is correct once again. But DOJ did not claim anywhere in its motion that the interview of Gen. Flynn was “unlawful” or “unjustified.” It stated that it was not conducted in connection with a properly predicated investigation, therefore his answers – even if interesting – were not legally “material” under the law.
More from McCord:
“[My interview] does not support that Mr. Flynn’s statements were not material.”
Correct. But DOJ never said its determination on materiality were connected to anything in her statement. Once again she responds to an argument that DOJ did not make in its motion.
But how does she reach her conclusion as to whether Gen. Flynn’s answers were material? She doesn’t tell us, so we’ll just have to take her at her word I guess. She’d probably tell us she never met the whistleblower either.
“And it does not support the Justice Department’s assertion that the continued prosecution of the case against Mr. Flynn, who pleaded guilty to knowingly making material false statements to the FBI, ‘would not serve the interests of justice.’”
This is her second effort to claim the “materiality” argument for her side — but it is also the second time she has done so without explaining how his answers were material, or how the position of DOJ on the issue is wrong.
Back to her op-ed:
“Notably, Mr. Barr’s motion to dismiss does not argue that the F.B.I. violated the Constitution or statutory law when agents interviewed Mr. Flynn about his calls with Mr. Kislyak. It doesn’t claim that they violated his Fifth Amendment rights by coercively questioning him when he wasn’t free to leave. Nor does the motion claim that the interview was the fruit of a search or seizure that violated the Fourth Amendment.”
Correct again. The motion does not mention any of these issues. So why does she bring them up? Is it that she doesn’t have much to offer about actual meaningful issues – like “materiality”?
Back to her op-ed:
The department concocts its materiality theory by arguing that the F.B.I. should not have been investigating Mr. Flynn at the time they interviewed him.
Incorrect. DOJ’s position is clearly articulated — FBI internal documents state that the FBI should not have been investigating Gen. Flynn at the time of his interview.
“No further investigative efforts are warranted.” Those words were written by the FBI’s Crossfire Hurricane team. In a courtroom that would be called an “Admission”.
McCord:
“And the department notes that the F.B.I. had intended to close the investigation of Mr. Flynn in early January 2017 until it learned of the conversations between Mr. Flynn and Mr. Kislyak around the same time.”
Finally!!!! She did need to resort to obfuscation and a mischaracterize of the FBI’s action, but at least she has landed in the right place in the 8th paragraph of her piece.
The problem, however, is that the FBI was not at the point of only “intending” to close the counterintelligence investigation of Gen. Flynn — the FBI did close the counterintelligence investigation of Gen. Flynn. The fact that the closing document was awaiting a supervisor’s approval — it was the supervisor who gave the directive to close the case — does not change the factual status of the investigation on January 4, 2017.
Who was running that investigation? The Crossfire Hurricane team was running it. What did the Crossfire Hurricane team write about the investigation? They wrote as follows:
Following the compilation of the above information , the [CROSSFIRE HURRICANE] team determined that CROSSFIRE RAZOR was no longer a viable candidate as part of the larger CROSSFIRE HURRICANE umbrella case.
Again, that’s not AG Barr, that’s not US Attorney Jensen, that’s not US Attorney Durham – that’s the “Crossfire Hurricane Team” after it spent 5 months investigating General Flynn as part of that investigation.
Back to McCord:
“Discounting the broader investigation and the possibility of Russian direction or control over Mr. Flynn, the department’s motion myopically homes in on the calls alone…”
Again, DOJ did not “discount the broader investigation” – the FBI’s Crossfire Hurricane team determined Gen. Flynn was “no longer a viable candidate as part of” the broader investigation. They were done investigating Gen. Flynn. The only thing new were the calls. So how is focusing “myopically” on the only new fact inappropriate? It’s not. If the new fact did not change the decision that had already been made, then the calls did not justify the interview.
Back to the op-ed:
ecause [DOJ] views those calls as “entirely appropriate,” it concludes the investigation should not have been extended and the interview should not have taken place.
Almost, but not quite. DOJ’s position is that making the calls was entirely appropriate for the incoming National Security Advisor, who was leading the Trump Transition team on national security matters. The calls were less than 30 days prior to the Trump Administration taking over the foreign policy of the United States. Gen. Flynn spoke to dozens of foreign officials during the transition. The fact that one of the officials he spoke with was the Russian Ambassador did not suggest or provide any basis for any further counterintelligence or criminal probe.
That leaves her with only the question of whether the content of the calls implicated any criminal or national security issues. On this point, DOJ stated in the motion that no criminal investigation had been predicated and opened – and on reviewing the calls DOJ found there to be nothing suggestive of criminal activity. In January 2017, DOJ, headed up by Sally Yates, dismissed the ludicrous suggestion that the calls might have violated the Logan Act. But that’s really irrelevant — if the FBI wanted to question Flynn about the Logan Act, it needed to open a criminal investigation, but it never did.
Back to McCord:
“What the account of my interview describes is a difference of opinion about what to do with the information that Mr. Flynn apparently had lied to the incoming vice president, Mr. Pence, and others in the incoming administration about whether he had discussed the Obama administration’s sanctions against Russia in his calls with Mr. Kislyak. Those apparent lies prompted Mr. Pence and others to convey inaccurate statements about the nature of the conversations in public news conferences and interviews.
Why was that so important? Because the Russians would have known what Mr. Flynn and Mr. Kislyak discussed. They would have known that, despite Mr. Pence’s and others’ denials, Mr. Flynn had in fact asked Russia not to escalate its response to the sanctions. Mr. Pence’s denial of this on national television, and his attribution of the denial to Mr. Flynn, put Mr. Flynn in a potentially compromised situation that the Russians could use against him.”
The potential for blackmail of Mr. Flynn by the Russians is what the former Justice Department leadership, including me, thought needed to be conveyed to the incoming White House. After all, Mr. Flynn was set to become the national security adviser, and it was untenable that Russia — which the intelligence community had just assessed had sought to interfere in the U.S. presidential election — might have leverage over him.”
Finally, we get to the “Crown Jewel” of obfuscation and misdirection – the completely bogus “Flynn was possibly compromised by his lies” nonsensical claptrap.
How exactly can Gen. Flynn be compromised when both the U.S. and the Russians knew every word said by Gen. Flynn in the conversations? How could Russia “compromise” Gen. Flynn by threatening to reveal information the US government already knew?
It goes without saying that the Russian Ambassador recorded his calls with Flynn. But how exactly would Gen. Flynn be compromised by the Russians threatening to reveal information already known to the US?
Let me change the facts and show you a circumstance about how he MIGHT have been compromised – under completely different facts. This is what the left WANTS the public to think happened.
Suppose that rather than a phone call, Gen. Flynn met with the Russian Ambassador on a park bench near DuPont Circle in D.C. And suppose that the Russians recorded everything that was said during the meeting, including something “provocative” or “unflattering” said by Gen. Flynn about VP Pence. Then suppose that members of the Trump Administration said something completely the opposite of what Gen. Flynn said to the Russian Ambassador in private.
In that circumstance, the Russians would know something unflattering said to them by Gen. Flynn, but it would be something that the US intelligence community would not know. The Russians could use a threat to reveal that unflattering information in order to try to leverage something out of Gen. Flynn.
BUT THAT DID NOT HAPPEN. The US and Russians all knew the same information, and both sides knew the other side had the same information.
So all the twaddle in McCord’s op-ed about Flynn being exposed to “blackmail”, and every other publication or broadcast where such nonsensical trope is raised, just understand that is propaganda, talking points, and disinformation — there is no factual basis for the claim.
The fact that Mary McCord would actually try to peddle such nonsense in the NYT only proves something I learned three times in my career with the Justice Department – at the end of a second Presidential term, after all the “talented” people have departed, people like Mary McCord ascend to positions of authority, and they make your life miserable over that final weeks and months of the outgoing Administration.
McCord:
“Although several of us at Justice thought the likelihood of a criminal prosecution under the Logan Act was quite low …. we certainly agreed that there was a counterintelligence threat.”
That’s fine – as far as it goes. But the Crossfire Hurricane team had already determined that Gen. Flynn was not an appropriate subject of a further counterintelligence investigation, so what “we” — McCord and others at DOJ — thought was irrelevant.
But how would Mary McCord be in a position to make such a judgment at all about the status of the investigation? According to her statement given to the SCO she was not aware until January 3, 2017, that the FBI was even investigating Gen. Flynn.
McCord first learned of the investigation into Mike Flynn on a phone call with Deputy Director Andy McCabe on January 3, 2017. In that call, McCabe told McCord the FBI had been planning to close their investigation on Flynn before discovering his telephone calls with Russian Ambassador Sergey Kislyak,
So McCord is in no position to opine on what impact the phone calls had on the nature and quantity of the information the FBI had developed about Gen. Flynn in the counter-intelligence investigation it had conducted over five months.
If the phone calls had changed the status of the investigation from the what was described in the January 4, 2017 Draft EC, then the only thing the FBI had to do was document what it was about the calls that changed it, reopen the investigation with an “Opening EC”, and off they could go. But the FBI did not do that — it did nothing instead. It left the situation exactly as it was before the phone calls. The final determination regarding Gen. Flynn was that he was “no longer a viable candidate as part of the larger CROSSFIRE HURRICANE umbrella case.”
McCord:
“But that “vacillation” has no bearing on whether the F.B.I. was justified in engaging in a voluntary interview with Mr. Flynn. It has no bearing on whether Mr. Flynn’s lies to the F.B.I. were material to its investigation into any links or coordination between Mr. Trump’s presidential campaign and Russia’s efforts to interfere in the 2016 election.”
That’s three times she has claimed the interview answers were “material”, but also three times she has failed to explain why and how that was the case. Three strikes and she’s OUT!!!
The DOJ motion goes into great detail as to why they were not material. Is it too much to ask that the folks clutching their pearls over the dismissal to offer up an explanation for why DOJ’s view is wrong??
“And perhaps more significant, it has no bearing on whether Mr. Flynn’s lies to the F.B.I. were material to the clear counterintelligence threat posed by the susceptible position Mr. Flynn put himself in when he told Mr. Pence and others in the new administration that he had not discussed the sanctions with Mr. Kislyak. The materiality is obvious.”
Wha….?? She just took a called 4th strike!! “The materiality is obvious” … words of an attorney unable to articulate a necessary fact in responding to a judge’s question. Seen it a million times. It seems to come out so easy her fourth time through the issue.
But this is the NYT — you can’t end an op-ed on something so self-degrading as that. So she had to throw in a straw man for her big finish:
“In short, the report of my interview does not anywhere suggest that the F.B.I.’s interview of Mr. Flynn was unconstitutional, unlawful or not “tethered” to any legitimate counterintelligence purpose.”
“Purpose”?? Intentions were good, so no harm/no foul? We had a pure heart so overlook our legal defects?
The key shortcoming on the issue of materiality has nothing to do with the “purpose” of the interview. As the DOJ motion clearly stated:
“…the interview of Mr.Flynn was untethered to, and unjustified by, the FBI’s counterintelligence investigation….”
Come on Mary — it’s right there in the name. They don’t call it the “Federal Bureau of Matters” … oops, wrong joke.

I want to give a “hat tip” to a person who inhabits the comments at Patterico.com under the moniker “Sammy Finkleman”. That may or may not be his true name, but he comments there frequently on legal matters, and often provides a significantly different view on the issues discussed.
Two days ago he posted a comment (No. 32) in which he included an excerpt from the transcript of the first sentencing hearing in the Flynn case before Judge Emmet Sullivan, which took place on Dec. 18, 2018. Sammy Finkleman’s comment set off alarm bells in my head based on my experiences in having taken maybe 1000 guilty pleas in my time as a federal prosecutor.
The Dec. 18 hearing was where Judge Sullivan made the infamous “suggestion” — via asking the prosecutor if the issue had been examined — that maybe Gen. Flynn might have committed treason. Later Judge Sullivan backtracked and offered a non-apology apology for his comments, and attempted to defend his motives for asking that loaded question. Yet even later in the hearing Judge Sullivan conceded that he didn’t even know what the elements of an offense charging treason might be. He made comments that clearly suggested he had a “jaundiced eye” with regard to the plea agreement and sentencing recommendation regarding Gen. Flynn because he disagreed with the disposition of the criminal case brought against Gen. Petreaus where he escaped with a misdemeanor conviction for unauthorized distribution of classified information. But hey, what’s the big deal over a bit of spiff-balling from the bench about “treason” even if you do happen to defame a retired 3 Star General with 33 years of uniformed service to his country?
So, I’m not of a mind to treat Judge Sullivan with any “deferential respect.”
Judge Sullivan screwed up the factual basis of the guilty plea entered by Gen. Flynn, and the procedure he employed was unsound and violated Rule 11 of the Federal Rules of Criminal Procedure. I think DOJ knows this to be the case, but given Judge Sullivan’s unpredictability they have opted to not “call him out” on it at this point. Instead, I suspect there is a hope that he may recognize his error — it’s right there in the transcript — and will instead grant the DOJ motion which solves his problem without him having to confront — or be confronted on — his own astonishing error.
Below are passages from the hearing transcript. I note the page number for each passage that instructs my conclusion.
P. 5 THE COURT: And there are some questions that I’m going to ask Mr. Flynn, and because this is an extension, in my opinion, of the plea colloquy, I’m going to ask the courtroom deputy at that time to administer the oath, because normally when we have plea colloquies, we always require a defendant to be under oath, and that’s what I’m going to do this morning, unless there are objections.
In this passage, Judge Sullivan admits that he believes a further “colloquy” is necessary with regard to Gen. Flynn’s decision to enter a guilty plea. That means that as of this point in the transcript, he still has not found that all the necessary subjects have been addressed to his satisfaction, and he’s not yet prepared to accept Gen. Flynn’s guilty plea.
Federal Rule of Criminal Procedure Rule 11(b)(3) states: Determining the Factual Basis for a Plea. Before entering judgment on a guilty plea, the court must determine that there is a factual basis for the plea. That means the Court must determine there are facts which satisfy each element of the charged offense before the Court can “enter judgment” against a defendant based on a guilty plea.
Judge Sullivan goes down that road here:
P. 7 THE COURT: As such, the Court concludes that it must now first ask Mr. Flynn certain questions to ensure that he entered his guilty plea knowingly, voluntarily, intelligently, and with fulsome and satisfactory advice of counsel. I cannot recall any incident in which the Court has ever accepted a plea of guilty from someone who maintained that he was not guilty, and I don’t intend to start today.
After addressing several matters raised by Gen. Flynn’s original attorneys in their Sentencing Statement — expressing some concern that the arguments made by the attorneys potentially impact the question of whether or not Gen. Flynn was really “accepting responsibility” for his conduct — in a very manner by which Judge Sullivan expressed a clear understanding that the press was going cover extensively what he said — Judge Sullivan walked back from his reservations on the “acceptance” issue (seeemingly to relief of prosecutor Van Grack), and stated as follows:
P.16
THE COURT: All right. I am satisfied that Mr. Flynn entered his guilty plea while competent and capable. He understood at that time the nature of the charges against him and the consequences of pleading guilty. Having carefully read all the materials provided to the Court in this case, including those materials reviewed under seal and in-camera, I conclude that there was and remains to be a factual basis for Mr. Flynn’s plea of guilty.
The problem is that while he said that, he never actually did that — which he happened to admit later in the hearing.
Remember, “materiality” is a a factual element of the offense of making a false statement to a federal agent. It is subject to proof at trial — meaning the prosecution must offer witness testimony or documents to prove “materiality”, and a jury would have to conclude that the evidence established “materiality” beyond a reasonable doubt”, i.e., that the false statement had a natural tendency to influence or to be capable of influencing the decision of the decision-maker to which it was addressed.
Under Rule 11, before Judge Sullivan could “enter judgment” on Gen. Flynn, he needed to determine that there was a factual basis — as to EACH element of the charged offense.
Here’s the part where he screwed up.
He didn’t do that — which he confirmed with his own comments, not once, but twice.
P. 19 Mr. Flynn admitted that his false statements or omissions impeded and had a material impact on the investigation, and when I ask questions of the government, I need to know answers about how he impeded the investigation and what the material impact on the investigation was.
Judge Sullivan states in open court and on the record he still does not know how the false statements were material. Without knowing that, he can’t determine if there actually is a factual basis for Gen. Flynn’s guilty plea because Judge Sullivan MUST KNOW that factual basis BEFORE he can adjudge Gen. Flynn to be guilty of the offense to which he is pleading guilty.
But Judge Sullivan didn’t just say he didn’t know if the statements were material one time — he came back to it at the end of the hearing and confirmed a second time that he didn’t know if Gen. Flynn’s statements were material.
P. 50 THE COURT: Let me just throw this out. Let me just share this with you. What I could do, and maybe it’s not appropriate to do it now, and maybe it’s not appropriate to do it in March. At some point — it probably won’t surprise you that I had many, many, many more questions, and at some point what I may do is share those questions with counsel so you can give some thought, maybe do some additional research to be prepared for an eventual sentencing. I’m not sure if I want to do that. I was not going to spend another hour and share those questions with you in open court today, had you decided to postpone sentencing, but I may do that. I’m not sure. These are questions that you would be prepared to answer anyway, such as, you know, how the government’s investigation was impeded? What was the material impact of the criminality? Things like that.
So, when discussing what might take place at the next hearing, Judge Sullivan reaffirms that he still needs to hear from both sides why Gen. Flynn’s statements were “material.”
Judge Sullivan entered judgment on a guilty plea without first finding that a factual basis existed. That violated the requirements of Rule 11, and makes the guilty plea unsound.
The DOJ motion says the issue of “materiality” cannot be factually established based on the investigative records in the case.
It is also clear that Judge Sullivan never made a finding on materiality that needs to be reversed.
The guilty plea was invalid as a matter of law independent of the DOJ motion.

List of officials who sought to 'unmask' Flynn released: Biden, Comey, Obama chief of staff among them
Top Obama administration officials purportedly requested to "unmask" the identity of Michael Flynn during the presidential transition period, according to a list of names from that controversial process made public on Wednesday.
The list was declassified in recent days by Acting Director of National Intelligence Richard Grenell, and then sent to GOP Sens. Chuck Grassley and Ron Johnson, who made the documents public. It features top figures including then-Vice President Joe Biden, then-FBI Director James Comey and intelligence chiefs John Brennan and James Clapper. It also included Obama's then-chief of staff, Denis McDonough.
"I declassified the enclosed document, which I am providing to you for your situational awareness," Grenell wrote to GOP senators in sending along the list.
Grenell’s letter was addressed to Sens. Grassley, R-Iowa, and Johnson, R-Wis., who had penned a letter to him and Attorney General Bill Barr regarding the declassification of files related to the unmasking process earlier in the day.
As Fox News previously reported, Grenell made the decision to declassify information about Obama administration officials who were involved in the “unmasking” of former national security adviser Michael Flynn — whose calls with the former Russian ambassador during the presidential transition were picked up in surveillance and later leaked.
Grenell appeared to have delivered those files to the DOJ last week. The declassified list showed recipients who “may have received Lt. Gen Flynn’s identity in response to a request processed between 8 November 2016 and 31 January 2017 to unmask an identity that had been generically referred to in an NSA foreign intelligence report,” the document, obtained by Fox News, read.
“Each individual was an authorized recipient of the original report and the unmasking was approved through NSA’s standard process, which includes a review of the justification for the request,” the document said. “Only certain personnel are authorized to submit unmasking requests into the NSA system. In this case, 16 authorized individuals requested unmasking for [REDACTED] different NSA intelligence reports for select identified principals.” The document added: “While the principals are identified below, we cannot confirm hey saw the unmasked information. This response does not include any requests outside of the specified time-frame.”

The U.S. Supreme Court ruled unanimously last week against the improper use of amicus briefs by judges to shape a court case as they wish — which is what Judge Emmet G. Sullivan is doing, critics say, in the ongoing Michael Flynn case.
On Tuesday, Judge Sullivan announced that he would accept amicus briefs about whether he should grant the Department of Justice’s (DOJ) motion to dismiss the case against Flynn. On Wednesday, Sullivan went a step further, appointing retired judge John Gleeson as amicus curiae (“friend of the court”) to argue against dismissal, and to argue Flynn be held in criminal contempt.
(Gleeson had already expressed his views in an op-ed in the Washington Post on Monday, attacking the DOJ’s motion.)
But last week, in the case of U.S. v. Sineneng-Smith, the Supreme Court held that the Ninth Circuit acted improperly by appointing three amici and directing them to brief issues that the judges wanted to consider — but the litigants had not raised.
Justice Ruth Bader Ginsburg, writing for a unanimous Court, held:
In our adversarial system of adjudication, we follow the principle of party presentation … [O]ur system “is designed around the premise that [parties represented by competent counsel] know what is best for them, and are reponsible for advancing the facts and argument entitling them to relief.” Id., at 386 (Scalia, J., concurring in part and concurring in judgment).
In short: “[C]ourts are essentially passive instruments of government.” United States v. Samuels, 808 F. 2d 1298, 1301 (CA8 1987) (Arnold, J., concurring in denial of reh’g en banc)). They “do not, or should not, sally forth each day looking for wrongs to right. [They] wait for cases to come to [them], and when [cases arise, courts] normally decide only questions presented by the parties.” Ibid.
While such amicus briefs could be used in “extraordinary circumstances,” the Court’s list of examples did not include cases in which prosecutors simply dropped a case.
Sullivan has been criticized for inviting the intervention of amicus briefs. In a Wall Street Journal op-ed published Wednesday, for example, Harvard Law School professor emeritus Alan Dershowitz argued that judges are “umpires,” not “ringmasters”: “If the litigants come to an agreement, there is no controversy. The case is over. … Judge Sullivan should get back to the business of deciding actual controversies and get out of the business of producing political shows.”

I don't think Durham is going to have any reports. I've read where he's coming with indictments. In fact, the prosecuters all over the country have been investigating all these people since Trump was elected. The general public doesn't know this. There are 160k + sealed indictments for all sorts of federal crimes all over the country. The normal number of sealed indictments is about 5k at any time. That means when the sh*t hits the fan, it's going to be glorious for us. The swamp is deep and wide. Their tenticles reach every crevasse and dark place.
I agree the longer this is in the news, the more it wakes up the snowflakes that still have a brain left. Some will never figure out they've been screwed over. About a year ago I was really tired of all this and wanted it to end. But I'm over that now. It will take as long as it takes and I can sit back and enjoy the struggle while the swamp tries their best to wiggle out of their mess. Trump has all the information he needs, he's just trying redpill people to minimize the riots and civil unrest that will happen when the arrests of their heros are made.
To explain further. A lot of the documents that were classified are now not classified. The people in the Obama administration who are in the middle of this have said they unmasked General Flynn. But there are no unmasking requests in the date range of the phone call in question. 12-29-2016. So how did they get the transcript of the phone call? Well see below. It turns out Obama can bypass legal requirements and the AG signs off on it. Imagine that. Ovomit knew and so did Loretta Lynch. The net gets wider and wider with every revelation. But this only applies to NON-American citizens. Ooops. Small problem.

In todays Dan Bongino report (35 minute mark) Flynn NEVER EVER mentions "sanctions" in the transcript of the phone call. He discusses expulsion of the Russian officials. So if he didn't talk about sanctions, how could it have been a lie that he said he didn't talk about sanctions with the Russian amassador?? He actually didn't mention sanctions at all. HMMMMMmmmm???

The Yates FBI interview notes indicate that “the interview was problematic” to her “because as a matter of protocol and as a courtesy, the White House Counsel’s Office should have been notified of the interview." She stressed that “the FBI’s approach was inconsistent with how things had been done.”
Flynn's lawyers have touted recently released FBI records as being exculpatory evidence that was concealed from the defense team. The documents suggest that now-fired FBI agent Peter Strzok and the FBI’s “7th floor” leadership stopped the bureau from closing its investigation into Flynn in early January 2017, even though investigators had uncovered “no derogatory information," after intercepts of Flynn's communications with the Russian envoy emerged. Emails from later that month show Strzok, along with then-FBI lawyer Lisa Page and several others, sought out ways to continue investigating Flynn, including by deploying the Logan Act.
In moving to drop the charges against Flynn, the Justice Department said that after reviewing newly disclosed materials, it agreed with Flynn’s attorneys that his interview with the FBI should never have taken place because his conversations with the Russian ambassador were “entirely appropriate.”
Among the Flynn records recently unveiled to the public were handwritten notes from former FBI Assistant Director of the Counterintelligence Division Bill Priestap on the day the FBI interviewed Flynn. “I believe we should rethink this,” Priestap wrote. “What is our goal? Truth/Admission or to get him to lie, so we can prosecute him or get him fired?”

Mr. (judge??) Sullivan, I had hoped all along that you would do the right thing, that you would realize that what you're trying to hide is known by people on both sides. I had hoped in knowing that you would consider the situation moot and do the right thing.
You did not. Instead you turned to your friends for more political favors and cover. So maybe exposing some of those crimes will prompt you to recuse yourself. It's obvious you can't be relied upon to do your job impartially and dismiss all charges, exonerating General Flynn.
We have met. I have unfortunately worked with Elijah Cummings on more than one occasion. The latest was when he asked me to "assess" the viability of his wife's political campaign. The access granted for that proved very very interesting.
Quick question "your honor", over the years how many millions of dollars in government funds did yourself and your buddy Elijah Cummings siphon off of Howard University? I guess you were right when you said " they don't need it they never amount to anything".
On a side note, I think it's very kind of you to help your a good friend Cummings in his little multimillion-dollar insurance fraud scheme. Like he said no one's ever going to get a police search warrant for federal judges house.
What better place to hide a bunch of "stolen" art work. I especially like the two of you have in your private office at home. You don't have any intention of giving those back do you? But I digress.

Perhaps I should point out the non politically advantageous cases
where you just stuck it to the defendant because you could, or because you didn't like them or their race, or because you had "fixed" so many other cases you had to make some of them look "normal". Any comment judge? Because it's about to get worse.
There was a "secret" deal in your courtroom, a deal threatening General Flynn's son. You can pretend it was a secret but you knew about it the entire time. You colluded with the prosecutor continuously. But all that's very obvious now. An innocent man faced with evil, evil against himself and his son. An honorable man, an intelligent man with integrity, a warrior, will stand in front of his son against any evil. An evil plan thought you knew of an allowed to happen. Then you pretended not to know anything about it.
And when it did finally come out you did not rebuke the prosecution for it.
General Flynn fell on a sword for his son, you cannot ask for a greater love or respect. I know it well, I had to do it for my wife and my family. ??
We just discussed a relationship between a father and his son. One of the strongest bonds in this world and beyond. I understand your a father as well.

I will go ahead and include them here. You have two sons, both of them violent no good pieces of crap that Daddy has had to cover for their whole life.

In 2012 he was arrested for the violent assault and rape of an underage girl. He beat and raped her for several hours at his home, and when he was "finished" with her, he left her laying on the floor while he went and watched television. He didn't give her another thought until approximately an hour later when he went to use the bathroom and she was still laying in the same spot, unresponsive. Did he call an ambulance out of concern? No.He left the house and called you from his car. You wanted to know who it was.
Obviously this has happened before and you wanted to know how bad clean up was going to be this time. This time it was the daughter of a "family friend", someone who owed you a lot someone you had enriched, and abusing your authority as usual you knew you could cover it up.
Instead of calling 911 because of"recordings", you instructed your son to call the local fire department directly. (Real shame they keep a recorded line as well ??) and once was dispatched to your sons address found the girl lying against the wall in the bedroom,
still unresponsive. They got her to the hospital, saved her life, she was bleeding externally and internally, another hour and she would not have made it, saving daddy's little namesake a murder charge.
But the ambulance company call the police reported it oh, your son was arrested. There was no way out the evidence was overwhelming so you and Cummings, and Rod took care of it. Lost in the system, no disposition. Still on the books but never made it to court.
Your son must be very lucky have you as a father. The girl was not as lucky. That was in 2012, this is 2020, this summer she'll be old enough to take her first legal drink. I don't know what she'll celebrate if she does, her life has been very difficult. Everything she's had to
go through, including her own family, her father that you control, telling her to "get over it". She has a lot to get over, at least she will never be burdened with a child like your buddy Obama says, no concessions for her, too much damage for that.
But you managed to bury it. Fast forward a few more years and the same son is picked up in a multi-state sting of online pedophiles. I'm sure all those pictures and videos he was trading, all those children oh, I'm sure they were asking for it too??
Back to your friends, Cummings, Catherine Pugh, rod. Funny how are your friends are corrupt or convicted. With that previous charge still on the books you really had to call in some favors to make this go away. Close to 900 people picked up, you managed to make that case

"A federal appeals court on Wednesday ordered a lower court to allow the case against former National Security Adviser Michael Flynn to be dismissed, as requested by the Justice Department -- likely ending the years-long legal saga stemming from the Russia investigation."
Retired Lt. Gen. Michael Flynn's legal team has received notes taken by former FBI special agent Peter Strzok.
A court filing Tuesday said U.S. Attorney Jeffrey Jensen of Missouri, who was picked by Attorney General William Barr to review the government's case against Flynn, "obtained and analyzed" the document.
"While the page itself is undated; we believe that the notes were taken in early January 2017, possibly between January 3 and January 5," acting U.S. Attorney Michael Sherwin for the District of Columbia wrote to Flynn's team. "These materials are covered by the Protective Order entered by the Court on February 21, 2018; additional documents may be forthcoming."
The one-page letter was submitted to the U.S. District Court for the District of Columbia as part of the discovery process.
Susan Rice, the national security adviser under President Barack Obama, wrote an email to herself detailing a Jan. 5, 2017, Oval Office discussion about the Flynn inquiry, which was part of the FBI's counterintelligence investigation into ties between the Trump campaign and Russia.
Flynn, who was President Trump's first national security adviser, pleaded guilty in December 2017 to lying to FBI investigators about his December 2016 conversations with a Russian envoy about a United Nations resolution on Israel and sanctions. But Flynn now claims he was set up by the FBI, and the Justice Department is seeking to drop the case.
Judge Emmet Sullivan, a President Bill Clinton appointee who has been handling the Flynn case since December 2017, has so far resisted dismissing the case right away.
Strzok took part in the Russia and Hillary Clinton email investigations.
Documents declassified in April indicate Strzok abruptly stopped the FBI from closing its investigation into Flynn in early January 2017 at the insistence of the FBI’s “7th floor” leadershipafter the bureau had uncovered “no derogatory information” on the incoming national security adviser.
Emails from later that month showed Strzok, along with FBI lawyer Lisa Page and several others, sought out ways to continue investigating Flynn, including by deploying the Logan Act.
Strzok also authored the “opening electronic communication" that initiated the FBI's counterintelligence investigation into the Trump campaign. After DOJ Inspector General Michael Horowitz uncovered anti-Trump text messages between Strzok and Page, Republicans accused them of being part of a plot to undermine Trump.
The FBI intercepted Flynn's discussions with the Russian ambassador, after which Strzok and another agent, believed to be Joseph Pientka, grilled him on the contents of the conversation on Jan. 24, 2017.
Former FBI Director James Comey admitted last year he took advantage of the chaos in the early days of Trump's administration when he sent Strzok and Pientka to talk to Flynn.
Notes from the FBI's head of counterintelligence, Bill Priestap, seem to show him casting doubt on the plan to interview Flynn, asking: “What is our goal? Truth/Admission or to get him to lie, so we can prosecute him or get him fired?”
Strzok was fired in August 2018 and a year later filed a wrongful termination lawsuit. In the face of repeated insults by Trump, Strzok warned in February that he will "have a great deal more to say about the president’s attacks on those with responsibility for holding him accountable."
Former Rep. Trey Gowdy recently told Fox News that Strzok may very likely be a target of U.S. Attorney John Durham's inquiry into the Russia investigation after Barr said "some" of the people his hand-picked federal prosecutor is scrutinizing would be familiar to the public.
There is a two-tier battle ongoing in the Flynn case.
At the district court level, Sullivan appointed a retired New York federal judge, John Gleeson, in May to serve as an amicus curiae to present arguments in opposition to the Justice Department’s motion to drop the false statement charges against Flynn, even asking Gleeson to look into possible perjury or contempt charges against the former Trump national security adviser.
Gleeson has argued the Justice Department engaged in “a gross abuse of prosecutorial power” in moving to dismiss the Flynn case. Flynn’s team countered that “the irony and sheer duplicity of Amicus’s accusations against the Justice Department now — which is finally exposing the truth — is stunning” and accused Gleeson of carrying out a “wrap-up smear.” The Justice Department has repeatedly insisted that “the Constitution vests in the Executive Branch the power to decide when — and when not — to prosecute potential crimes.” A hearing is scheduled for July.
The Flynn team and DOJ lawyers also argued separately before the U.S. Court of Appeals in D.C. earlier in June against an outside lawyer hired by Sullivan, urging the court to issue a writ of mandamus telling the judge to dismiss the case. The appeals court has not yet issued a ruling.

More exculpatory evidence hidden from the Flynn attorney. Biden categorically denies knowing anything or being involved in the Flynn take down. Proven lie. Just like he wan't involved in a quid pro quo with Ukraine. Sure.
Just in case you don't understand what was just said. They KNOW Flynn didn't do anything wrong. It was his JOB to talk to the Russian Ambassador as incoming admin official. They were using the Logan Act as a pretense to get him between a rock and a hard place. Add that to the fact that Flynn didn't lie. Files unsealed in the final stages of Michael Flynn’s years-long court struggle reveal a real stunner — confirmation that President Barack Obama played a central role in foisting the whole phony Russiagate “scandal” on the country.
Notes handwritten by (now disgraced) FBI agent Peter Strzok show Obama, with then-Veep Joe Biden playing along, encouraging the FBI and Justice Department’s investigation of Flynn, even as they were told his actions “appear legit.”
The document, plainly Strzok’s notes of FBI chief Jim Comey’s account, offer more details of the Jan. 5, 2017, Oval Office meeting of Obama, Biden, Comey, National Security Adviser Susan Rice and Deputy Attorney General Sally Yates.
On learning that the FBI was set to close its investigation into Flynn after finding no evidence of wrongdoing, Obama and Biden suggested finding ways to keep it open, with Biden bringing up the (dead letter) Logan Act.
More, the notes have Obama ordering the continued investigation be kept secret from the incoming president and his people: “Make sure you look at things and have the right people on it.”
In the new administration, holdovers Comey and Yates did manage to take out Flynn, sidelining any effective White House oversight of the rogue Russiagate probe — and allowing it to metastasize.
Biden told ABC last month, “I know nothing about those moves to investigate Michael Flynn.” Was he lying, or has his memory grown that bad?
US Attorney John Durham is reviewing the origins of the Russiagate probe to see just what was unlawful or inappropriate. The public needs to hear his report well before November’s election.
General Michael Flynn had to be removed. He knew too much. He had to be shut down and silenced. He was the primary Deep State target.
Sidney Powell was on the Vicki McKenna radio show and she dropped another bomb. Per a report from Lifezette, General Michael Flynn’s attorney Sidney Powell shared the following:
“He was going to audit the intel agencies because he knew about the billions Brennan and company were running off the books,” Powell said, referring to former CIA Director John Brennan.
Powell began her interview noting at the 1:00 mark that when she took over the Flynn case three things were very, very troubling and egregious:
One – he was not properly informed of what the government had even disclosed to his defense lawyers prior to the plea.
Secondly, the government didn’t disclose a fraction of what it should have disclosed (i.e. the whole case was made up).
And three, he was prosecuted and threatened with the prosecution of his son. That’s how they coerced the guilty plea. It was just unconscionable conduct to threaten to indict him and his son the very next day and give them the Manafort treatment if he didn’t enter his plea right then, and I’m convinced it’s because they knew right then the press was going to explode with the Strzok-Page text messages and everything.
Then Powell drops the bomb at the 5:50 mark where she discloses that Flynn was going to audit the Intel agencies because he knew about the billions former CIA Director John Brennan was running off the books.

General Flynn could take down the NWO agenda within the US involving at least the last 4 Administrations.

Bombshell: It was Bill Clinton who brought Gulen and his terrorist network to the United States. In 1998 Bill rolled out the red carpet and had him flown here in a private CIA plane. Clinton knew full well that Gulen was wanted in Turkey and other nations for terrorist activities.
Gulen owns the largest chain of charter schools in the US. The Charter Schools receive a half a billion dollars per year of our taxpayer money..
The US/jihadist operation morphed into the Arab Spring, destabilized the Middle East and created the orchestrated migrant crisis.
Hillary took part in the launching of the Arab Spring as Secretary of State under Obama. To the woman candidate, Gaddafi’s brutal torture and murder was hilarious. “We came. We saw. He died.”
The largest terrorist network cell is Gulen’s network and it has been allowed to flourish within the United States for more than 20 years. Gulen has had the protection of the last 3 Presidents, the State Department the CIA and the FBI.
Unlike Flynn, Mueller was Obama’s yes man. He supervised the squashing of all government records and whistle blowers that implicate the Gulen network in any criminal, espionage or terrorist activities. He also shut down related FBI investigations and hindered Congressional oversight.
Only after the attempted coup in Turkey did some of these facts surface in the mainstream media.

For revenge and to neutralize Flynn’s threat of exposing ties to Gulen, the Obama White House launched a campaign of leaks to the media to slander Flynn 6 months before Mueller’s council was appointed.
The smear campaign alleging that he was not forthcoming about some coversations he had with the Russian Ambassador forced General Flynn out of his new job as National Security Adviser for the Trump Administration.
The Russian investigation morphed into a Middle East investigation. Mueller was on Flynn’s tail and using his unchecked authority he cooked up “Turkeygate.”
Turkeygate charges that Flynn took part in a plot to kidnap Fetullah Gulen and return him to his home country. General Flynn and his son allegedly would receive roughly $15 million dollars for the kidnapping gig.
In addition to Russia there is another conflict of interest-involving the Middle East.
Mueller has a history of covering for terrorist organizations. Obama ordered the DHS to scrub records of terror ties to Muslims. Similarly, per Obama’s orders and with Islamic oversight Mueller’s FBI scrubbed “offensive” references to Radical Islam in FBI training manuals.
He also utilized his position as Director to cover for Gulen’s network and took action to squash Michael Flynn’s whistle-blowing reports.
