We bought 5 mares through a sale that were all bred. The previous owner did everything needed as far as stud report and DNA on both stud and mare. All that AQHA is now requesting from the new owner is a genetic test. We contacted the Lady and she agreed to do it if we would pay for the kit. Which we did. Now she will not answer the phone for us or AQHA. She is refusing to get the kit sent in. Do we have any legal grounds to stand on with her? We even drove 500 plus miles to her house and politely asked her to send it in and offered to purchase the stud for the price she had previously asked us and she called the police.  We were sited for trespassing.  We have super nice babies on the ground and are at her mercy.  Any advice would be greatly appreciated. 

If she will not cooperate, there isn't much you can do. The only suggestion is to register the foals in the half quarter horse registry. That is a waste of money to me but I do know some big name breeders that have listed young horses for sale that are registered in that half quarter horse registry. I just do not understand people. The only other thing is ask if AQHA can used the previous DNA test for that genetic testing. You may have to call UC Davis for an answer to that question. Maybe if you get a lawyer to send her a friendly letter it would help. 

I would think if the animals were bought as 'registered' the law would be on your side.

Also, you said that you bought them through a sale...what does the sale barn say?

Calling AQHA would be your best bet on solving this problem, if they can help thats great if they cant help then move on with a different plan. 

Trying to see if I am reading this correctly. . you need the genetic testing on the babies?  If that is the case. . that has pretty much become standard for AQHA.  You have the babies. . get the test and send the hairs in.  AQHA can also help you work through it.  When I have sold pregnant mares. . it can be done and AQHA sends me a little deal through their site and poof. . the registration can be finished up with AQHA. 

I think OP is talking about the 5 panel test and apparently the stallion was also sold in the same. New owner needs to understand that the stallion is worthless without the 5 panel test, however, they are at the stallion owner's mercy.
