Do any one have a contract that says something about not selling a horse until pick up is arranged? Someone is buying my horse from out of state, and it will be a few weeks until she can pick her up. She is putting a down payment down and we would both like a contract that covers both of us. Thanks in Advance!!!!

never heard of a contract for that, but that is the point of the downpayment. You take it to say you will hold horse, it is non refundable saying if she changes mind, you get to keep it since horse is no longer on the market.

Thank you! She said she has had horses sold from underneath her so she wanted something saying she was going to buy her, put the deposit down, and that I would keep her on the property until she came to get my mare.

Just write it down the way you guys have discussed it. It doesn't have to be anything fancy. I would, however, put in a deadline that the horse will be picked up by. You also don't want this to be strung out forever. Is she going to reimburse you for feed, care during this time?

Be sure and discuss who is responsible should any thing happen to the horse, vet bills etc.  Keeping a horse for weeks waiting for pick up always makes me nervous.

very much agree with agreeing on a pick up date and discussing death or injury to the horse. I usually refund all monies if something happens to the horse because I can't get it shipped in time or in from pasture due to weather or whatever, they are responsible if they can't come get it right away. I always recommend insurance.

My contracts usually have  a date by which the horse has to be paid for in full, and with that I give the buyer 30 days after full payment to arrange transportation for the horse unless other arrangements have been made.  After 30 days they pay board & all other expenses.

I agree with other posts. I wouldn't worry so much about an agreement that you won't sell the horse from under her but more of an agreement which states the:

Pick up date (timeframe at the very least -- ie. week of XX)
Costs for care after the timeframe (at a per day rate for feed & care)
That she is responsible for all vet/farrier and related expense from the date you sign the agreement
That the deposit is non-refundable

If it's more than a week or so away I would strongly agree that if you don't have insurance on the horse that your require that she take out a temporary insurance policy.

If she pays for it in full then there are no worries.  She needs to pay in full and insure it and pay you board

You would be surprised at how many times over the years I have been paid a deposit only to NOT have the horse picked up on time, or even not at all. 
Thus why I had to start putting a specific date in the contract and deposits that are not refund-able. 
And ditto to the insurance as well.
