ropenrun - 2015-04-10 2:37 PM The company that did the videoing at Pasco is the same company that came on here last year discussing closing videoing to anyone other than themselves.  As a producer myself, I would never let this be a condition of providing that service at an event.  I would need to think very hard about entering an event with that stipulation as well.  And I have entered Sand Cup several times in the past.  It just is not right and especially when it is not advertised in advance of an event on a flyer or in the rules of the entry form.  And if they say no personal videoing and you do not support that event, they all lose money.  I think this could be a legal can of worms that a producer would really not want to get involved with.  As someone said we do not ask them to video our run.  Maybe that should be placed on the entry form - you either give them permission to video or photograph or you don't.  If you give them permission then they have exclusive rights but if you do not give them permission then you have every right to video your own.  I would be real curious as to the legalities of this.  And you may not get an answer back from the Sand Cup producer until after this weekend as she is entered at another futurity in WA this weekend.

Yes to all of this.   I am going to watch the races tomorrow for the day and if I run into the Sand Cup Producer and she has time, I will ask her.  Otherwise we can wait until next week.  Happy Friday everyone!

All of this. Unless you sign it away, the right to video/photograph yourself is YOURS. Not theirs. There's no legal backbone to this.

Well I am glad to hear some of the info and get it straight since I was not there. I guess if they see me or my people videoing they can come do a citizens arrest! HAHA Perhaps they should do some more research and get a better understanding of the LAW. So many people throw words and especially FB postings around that hold little to no ground.

Went to a show once was taking photos of my kids and Kenneth Springer came to me told me I was not allowed to take pics or even have a camera in the arena. I said ok walked up two steps and continue to take pics. He approched me again with the producer I them told him I was the mother not a pro and I would take pics and walked off.

I mean I get it. Professional photography or videography people want paid for their services. But seriously.... what footage of a radius to they get to call exclusively theirs?? I have been videoing my runs and posting them for years. Some professional, who I did not ask to video me, will not come in and tell me I cant do that anymore because they are doing it and they want paid to do it. They own the rights?? Really? I dont remember selling mine! They have the rights to their footage and I have the rights to mine.

I don't have a dog in this fight as I'm from California (right side).  Wouldn't they need my permission to take my picture or even video me if we want to start splitting straws here...

The video company in question tried that angle around here also. They tried to get a big race producer to tack on a fee to the entry fee for them videoing the runs. And they wanted to ban all cell phones and any video equipment from the arena during the race. The producer said NO to all and the company did not work at that race.

This is a FB post made last week by the lady who runs the video company...

dear producers, we are here to help promote your show, and sponsors with our live webcasts and videos that we share online and to networks after the event. As you know times have changed and so many other videographers have hung things up, but we are here to change things. We are mostly doing this with our live webcast productions, but still have to count on some sales at a show. We just ask that you promote us, as much as we do you. That means don't share or post a cell phone or tablet video on your facebook page when there is a professional videographer that you hired. If the run was good enough to share, then come to us and we can give you the professional version for free, if you promote us at the same time. Our thinking is if 1000 people see the free video, and maybe 10 buy because of it, then we are ahead. We also send our videos into RFD TV, and other networks and shows and sometimes they are selected to be shown. This is once again how we promote your show. We just ask that when you mention that on Facebook, we get at least a mention in the post, and maybe how people can buy their videos.

They have no merit to stand on in my opinion and little credibility. It's preposterous to even ask that of people and I would have to just go ahead and do as I pleased.

That's crazy. A few years ago when another company had that race they were in the stands videoing people for less money. Which is very rude business. Here recently at the Patriot did the same thing. Seems like they are quick to blast people if they feel they are wronged but will step on other people's toes in a heartbeat.
