Howdy all,

Looking for a bit of legal help here.

I currently have two horses in my care that are owned by a dear friend of mine who is near 80 years young. One is broodmare that I have been breeding (AQHA breeding lease filed each year) and the other is riding horse (No AQHA riding lease on file since we are not showing in AQHA events).

My friend recently called me and asked that I begin whatever paperwork was needed to have these two horses be transfered to me if anything was to happen to her, lord forbid, as she has no horsey family to take care of them.

Would anyone know what steps would be appropriate for us to take in this process? Thank you in advance!

Call AQHA and get some transfer reports and have your friend fill them out and put the horses under your name, just do it like she is selling them to you.. You can call and talk to someone at AQHA too about this, I have giving horses to friends over the years and I just fill out the transfer report and hand them over to who ever is getting the horse with the horses papers and them send them in to AQHA.

1. Have your friend sign a transfer now.

2. Have your friend put a directive in her will that you get said horses upon her death.

 

all our horses are currently owned by are Trust and it’s in my will that those horses go to my sister upon my death .

Since the horse owner is 80 years old, IMHO she should speak with an attorney regarding best way to make this happen -- and assure it's all covered legally within her Will and final wishes.  This should help avoid issues with heirs regarding ownership of the horses.  Her heirs could come forward saying your coerced her into giving you these horses and she would not be around to refute it.  I've seen many of these 'she said she wanted 'whatever' to go to 'whomever' go very sour.  Unless it's legally executed, it usually does not end up well.   This is why I have a Will and Trust with detailed instructions....  Seek legal advice.

I would ask her to have her attorney add a codicil to her will stating that the horses go to you at her passing and have signed transfers attached to that legal paperwork. The other option is to have her transfer the horses NOW into your name.
