| what type of attorney do you contact when mining threatens the safety of you & your horses? number #3 Horse & rider fatality deaths is mining. Public works purchased property adjoining us, the county board issued a permit & we were told to move or leave our premises while in operation. We have trained & sold barrel horses here for 30 years. Public Works has not obtained the necessary permits regarding environmental, pollution, state & water permits, water appropriation permits, road haul permits, & never hired a licensed land surveyor to draw required lines prior to purchase or even had it appraised as is required. Now we can't run fencing due to the lines being parallel to the extraction sight. Is there footage requirements protecting agricultural property lines from this type of situation? HELP. |

Location: Kansas | Uggg...that stinks!! I suggest your first stop would be to check (online) for your local / county / city / state zoning regulations. Most areas have lots of information regarding what need to be or should be done prior to building / digging / or anything needing a permit. I would think that most areas have something set in place for excavation / drilling requirements pre and during site work. Set backs and legal right of ways should be addressed in these written works too. Best of luck. I live in close proximity to a city (but I have Ag Land and the long term planning goals for the cities future show my land being something other than farm / hay / Ag land.....unfortunatly it will impact me with option I choose for my land use. Doesn't seem right, but that is the world. |

| Tried to talk to the DNR about the fact that county public works plan on excavating 40ft. down & our water table is at 20ft. Their supposed to get the required permits but have not. They claim "it SHOULD" be okay. DNR claims it is an environmental issue not theirs. While gravel is depleting & is a natural resource that cannot be replaced, public works will encroach on adjoining properties. New comprehensive plans in counties planning & zoning commitees needs to be addressed. Horse are fight or flight animals, our arena is less than 125ft. from the projected haul road. The county board is not recognizing horses as agricultural only as recreational & stricter permits need to be addressed whenit comes to mining next to horse farms-racing facilities for the safety of horse, rider, & the loss of livilhood. Am not certain what type of attorney to councel with-environmental, human rights, land use attorney? |
