We were involved in minor accident where one team of drafts spooked and ran into my husband, throwing him into the hind legs of his own draft team, which took off and damaged a parked vehicle.  Minor damage (still costly), yet we contacted our insurance and found out this would be under a commercial type policy not our farm policy, therefore we aren't covered.   So, any suggestions on options??   I would advise all to examine their policies to make sure you know what you've got!

I could see that. We seem to have every type of insurance available and learn when things like this happen, that we need more. There are always loopholes. They are basically hedging a bet that they dont have to pay. The biggest lesson I learned in the last 10 years was collapse coverage from ice on our barn. It is not a standard coverage. And many had roofs cave in. So if you dont have that you might look in to it.

Best that I can understand, our auto insurance covers contents of the trailer and damage should it detach. You might try your homeowners policy? There is some sort of liability clause, if for instance your horse gets out of the pasture and is hit by a car. I wish I had advice for you. Maybe the facilty where the event was held has an umbrella policy?
Keep us posted on how this turns out.

I always had commercial coverage when I had my carriages/wagons.
I guess it depends on if you were working for $$ (?

He was simply a contestant at the State Fair.   Same as competing in jackpots or rodeos.   Since we all know how lucrative that is (NOT), it is still considered "for profit" therefore Commercial, I guess.  Homeowners comes in when he does anything other than for prizes or money, such as doing a wedding as a gift.

Our farm policy has a small BOP for "showing livestock". It would cover any liability claims that may arise while on the road competing. Also, unless you have cargo insurance or have your livestock scheduled, if you were to have an accident, whatever is inside your trailer is not covered. Your trailer itself also isn't covered unless insured separately. The liability only pays the damage you do to someone else's property. Common misconception!

Has anyone ever had any experience with an insurance company denying coverage because they determined insureds were not "legally" liable. We recently submitted a claim under our homeowners policy for damages to a car when wolves chased our horses through the fence and onto the highway. The insurance company denied coverage because their investigation determined our fences were more than adequate and it wasn't our fault wolves were after the horses. We did had a special rider on homeowners policy for liability in the event something like this ever happened. They said it wasn't our fault, we weren't "legally" liable, so no coverage.

Did a court find you legally liable? Different states have different laws regarding livestock, mine is an open range state.

My boyfriends gelding backed right into a car a few weeks ago at a rodeo......a woman ran at his horse with a flag, causing his gelding to shoot backwards where an idiot was driving his car where it was not suppose to be, and his gelding smacked the fender. Left a large rump sized dent lol.

The guy with the car tracked him down and yelled at my bf, but I was always told that when on rodeo/fair grounds it's an at your own risk kind of deal.....or am I wrong?

Absolutely....

What did you do that was negligent? In a liability claim situation, there has to be negligence. Wolves chasing your horses was an "act of God". If your fences were down constantly and in bad repair and people always complained about your horses being out....completely different story.

I would have to say this is wrong......I don't care where you are..if your horse damages someone elses property...there could be a liability issue. Keep in mind if someone sues you for a liability claim, even if the insurance company denies the claim, they still pay for your defense ..which can be a big expense.

Does your farm policy specifically exclude this? (competing at a rodeo, event etc...) If not...I would be questioning this. Being a constestant is not a commercial risk.

Well the guy didn't bother getting his name....so guess we don't need to worry about it

Banjo...you are correct....I was at a rodeo years ago when a girl tied her horse to the concession stand dumpster (yes, I couldn't believe it either!)...it scared him and he drug the dumpster towards the parked trucks and trailers and hit my truck along with a few others....a roper cut the reins and the horse was ok, but the vehicles were not....the girl's parent's immediately offered to turn the damage in to their insurance company and got all of our information, (they were RUC members working in the concession stand)....lucky for us that their insurance paid for all of the damage done...lucky for them that no one was hurt....
