Oregon is a free range state so here, the truck driver would be liable. In fact I know of a person that wasn't bother by thier old broodmare getting out and she ended up on the highway and was hit. Suddenly this old crazy nag became a prized pig to a tune of 15K. It really bothered me.
As to your situation I'm sorry that you had to witness this, I probably would have made myself put the horse down, I couldn't imagine watching a horse suffer like that.

It was horrible, I did my best to calm it down and keep it still. Even though I knew there was nothing that could be done for it.

Clarification~ Parts of Oregon (mainly north west side) are NOT free Range - in these areas  the animal owner is 100% liable for all damages. There are specific signs stating "Free Range" in area's where the driver will be responsible.

Kudos - that is a hard situation - I have sadly come upon two accidents with horses - all you can do is try to calm them until owner arrives. Sad but true - In our area Police will not even shut them as they have been sued over just that.  Know that you did everything you could do and calming them does seem to ease the panic in their eyes.

I would have called the sheriff or police-whichever-and had them do it.
When I was a kid, we suspected some disgrutled neighbors had let our horses loose. One had gotten hit and the police were called. They tried to traq him but it didn't work. He was still frailing around when we drove up. Cost my dad a new car best I remember and my sister a horse. Bad and sad deal all the way around. Wish I had never seen it and sorry you did

Boy, I'm really sorry that you had to witness that. That is a tough situation. Regardless of the law, I, personally would have put him down if I was able to and play stupid girl if it was brought up. But, I, also, can not stand to see an animal suffer. Can not stand it.  

I probably would have done the same. Can't say for sure unless it actually happened to me. I honest would not have thought about the legality of it all though.
