So this is a for mare or stud owners. For stud owners, have you ever ammended a breeding contract for a mare owner to the basis of this: in your contract you have a lfg, itstates that if mare doesn't foal live foal then they can rebreed same or next season to same stud or another stud you have (standard) I think. But a mare owner says that they only want to breed if it states they will get a full refund because they may not want the rebreed..
Or mare owners ever seen a contract worded this way?
I've never seen a contract worded like this but maybe I've just missed them?

Whatever the stallion owner decides to do in this situation, they should remember that their time spent trying to get the mare bred is valuable and a full refund seems a bit unfair. Especially if you are hauling the stallion to a vet to be collected for shipping semen...

That would be best case scenario for mare owner, but I have never found one that offered a full refund.

I got a refund once from Lazy E - the stallion I was booked to and paid in full broke a leg and was out for the season.  They offered to apply what I had paid toward another Lazy E stallion, but that was the only one at the time that I was interested in, sans CC  -  but my fee was a drop in the bucket to his fee, lol!   

I have lost two stud fees over the years for other various reasons and had to talk to Mr. Stanley very nicely to extend my DFP contract for another year (after two other extensions).

I've never had a contract that offered a refund at all that I know of. Just ability to re-breed.

In the TB world it is common to have a contract where you pay a booking fee, which is non-refundable, you pay all the board and vet work as stated in the contract (usually when you take the mare home in foal), then nothing else is due until you have a live foal on the ground. Before you can get the breeders certificate to register the foal, you have to be paid in full.  I believe this is the way it is because most people who breed TB's are in it to race. No papers, no racing. There's a bit of leverage there for the stallion owner.  In this contract you have NO Live Foal Guarantee.  If you pay all the fees above and your mare doesn't get in foal the contract is complete and you get nothing without paying for all of the above again.

In the stock horse world papers are less important to people; just read some of the threads on here where people say "papers don't matter".  In this case most stallion owners want to have some money in hand because of the ease there is of the mare owner walking away without paying for the stud fee in full because the mare owner doesn't care.  As stallion owners, we have a lot of money invested in our stallions, advertising and in the incentive programs we seem to need to do in order to attract mare owners to breed.

Amy Schimke just had a thread about people who DO pay in full not caring enough to register their babies or pay them into the incentives she spends $1000's to provide for them.

Best you can hope for is the stallion owner will let you sell the breeding. Thats the only way you will under normal circumstanes get your money back.

If my mare didn't take the first time, I would definitely want to try to breed her again for sure.  But then I would also pray she would take and have a live foal.

I think any breeder that offers a live foal garauntee is taking a huge huge risk because so much can happen, so those that offer it have my respect.  If my mare was one of the ones that fell in the category and I could not or did not want to breed her again, I would hope I could work something out with the stallion owners to either get a partial refund, sell the breeding, or opt to breed a different mare, but I would never ask or expect a full refund, and I would expect to cover all the fees not actually associated with the initial stud fee (AI fees, boarding, vet, etc).  Everybody, stallion owners as well as mare owners, must assume a certain amount of risk when choosing to breed and must be willing to be responsible for that risk.

In this case the lfg states that they can rebreed same or following season to same stud or different stud also they have the option to change mares. Mare owner brought up the fact that they wouldn't get breeders cert if they didn't pay but..
I know from the past that stock horses don't always register and I don't want to be rudebut I want the foals by my stud papered and I know it isn't a guarantee either way. My concern is that what if the mare did take and they didn't care about papers so they never informed me.
It can be argued that they had been burned in past but so are many stud owners. I had never heard of such a thing with qhs and was curious. Thank you for all the responses.
