Sounds like the court decided the plaintiff didn't have enough to make a case. Also states that TRIBUTE apparently SETTLED the case.IM GONNA SAY SINCE THE REPS OR THE COMPANY WONT GIVE AN EXPLANATION that they simply settlers to keep out if the public eye?OH...AND I DID GOOGLE ....dang had to get all the way to end of lawsuit to find just a couple sentences that says very little.So.Im bumping up again to see if any reps or the company will give an explanation of the details :))))))

The claim was dismissed 2 weeks ago.
I have attached the official court document showing that the case was dismissed.

The claim was dismissed 2 weeks ago. I have attached the official court document showing that the case was dismissed.
According to the court documents: "Kalmbach / Tribute Equine Nutrition never answered the suit, but apparently settled case. Plaintiffs dismissed the suit against Kalmbach with prejudice on October 14, 2016."
Why was the suit never answered, why did they settle out of court, and what was the settlement. Of course, if settled to satisfaction of the plantifs requests... they will drop the suit. That does not make the company not at fault. Please expain. |

| And while we are at it, is Tribute still contracting the same mill that the FDA found in violation of cross contamination, to mix their horse feed? I was always told that Tribute was made only at monoesin free mills. |

Did you seriously just lie to us and say Tribute mills at ionophore free facilities even thought the FDA has a statement stating that on March 20th medicated cattle feed was processed on the same mixer line as non medicated horse feed?  |

Just means the individual who filed the claim, have dropped it and that it can not be brought back up in court again.
I may be wrong (lets see what a Tribute rep will say) but I'm gonna guess that Tribute realizing they were caught paid off the complaint with enough money if they would drop it and keep it out of the public eye.

| If the plaintiff dismisses the case with prejudice it means they got something for the dismissal. With prejudice means it can't be refiled. It doesn't get dismissed with prejudice at the start of the case very often and if a plaintiff does it, then they had a reason. The question to ask tribute is did you give the plaintiffs something for the dismissal. A statement" the case was dismissed is not an answer." and does not mean there was not a viable claim. |

       Location: South Central Florida | Can someone tell me when the product problem became public and what was the problem? Maybe I'm just lucky. We had a problem with 2 mares that coughed constantly when fed Tribute. I didn't suspect it at first, but everyone else was fine (5 total on Tribute). Dealer was out of feed, and I had to do a month back on Impact 12. The coughs went away. I assumed just an allergy, or maybe a little bug. No nasal discharge, no fever, no wheezing. Tribute came back in, and in a week...same two mares were coughing again. They coughed in the pasture, but much worse if ridden or worked out. Vet check...horses were fine and lungs sounded clear but they presistantly coughed. Obviously I went back to the original feed (I spent more than I saved in vet bills :) ) They have been fine ever since. I am guessing there was something in the feed that those two mares had an allergic reaction to but I have no idea what. I never said anything because the feed is popular around here and I figured if there were a problem, I would be hearing. Somehow I missed this though. My horses are fine, no residual problems. The mares were not related and were in different pastures. The only thing I could figure out was the feed.
