I gave up and have turned everything over the Board of Veterinarian Medicine. Either they don't return your phone calls, or if it's not for a large sum of money, they don't want to mess with you. Even one attorney here in Fort Worth wouldn't look at the case cause one of their associates is a daughter to a vet in Aubrey, keep in mind that vet wasn't even part of the situation.

ย Yes I did get several X-rays of the problem area. Between the purchase price and vet work since then trying to fix issues I'm looking at close to 10k. Not a lot to some people but a decent chunk of money for me... The vet was neither the sellers nor mine. The vet was just a recommended one for that area.ย

The problem with prepurchase exams, is you get what you pay for.

If it was a cheap prepurchase expect a cheap exam.

My vet used to do a lot in the dressage world, the prepurchase exams started at 10k and went from there.

Also a lameness exam is subjective, it is only as good as the persons knowledge. I had a broodmare at the vets this year for repro, one vet was being evaluated by the vet association, 5 vets observed this mare, including my regular vet, a few surgeons from the most repitable clinic in Alberta, all passed her on the flexion test. Her toes were long. Brought her home, trimmed her feet, she went dead lame, hoof testers show me it is something to do with her frog, currently treating now. 5 vets missed it.

Xray machines are not all created equal, I had one horse I knew something was the matter with local vet xrayed said a soft tissue injury, even I couldn't see the fracture. Sent the X-rays to my vet, he couldn't see the fracture either, but he seen at the bottom of the xray the metatarsals were misaligned slightly.

My regular vet xrayed him the next day the spiral fracture light up like a Christmas tree. I learned my lesson about xray machines and the people reading them.

Just things to keep in your mind on your next prepurchase

I had several recommendations for this vet from people living in that area is why I chose the clinic.
I would still like to speak with an attorney if possible, if anyone has recommendations.
I will definitely take this as a lesson to be learned, but the fracture was very obvious in x-rays, even poor ones.

We are not getting what we pay for these days when it comes to a lot of people in the horse business.......vets, trainers, shoers, etc. I wish you well and you should stick to your guns and go for it if you have the xrays from the prepurchase exam that show a fracture. You can probably also go after the seller for fraud. I would find out who their vet is and subpoena their vet records. I'm so sick of seeing so many people ripped off in this business. (speaking from experience)
