Hello everyone! So I have attached my copy of my board agreement on here. I moved my horse to a new boarding facility back in February of this year. Of course, being dissatisfied with the care that my horse has received, I found another place to board a couple days ago. I do have two horses boarded there right now, I got another horse and moved her there in April. But, I never signed a contract for her, or never was asked to add her on to my original contract. Normally, I would still want to be respectful and agree to whatever the outcome is, but the BO is being extremely rude, aggressive and threatening small claims court. The contract does specify a 30 day notice must be given, I admit. I gave my notice on the 15th of this month, and told her that I would have my horses moved by the last day of this month (July). Now, I know that is not a 30 day notice, but a 16 day notice. BO wants me to pay my full board for BOTH horses for next month, August, otherwise threatening to take me to court. In my eyes, I do not owe them a dang dime! My horse is on stall rest for injury, there is a note on his stall, and I have came out MULTIPLE times to him turned out in the large outdoor arena! I do have pictures. Also, the contract states that I want him fed ALFALFA hay only. The BO goes on vacation for extended periods of time in the summer, and this last time they ran out of alfalfa, and almost out of hay entirely! So my horses both had local grass hay for 4-5 days. There are safety hazards going on at the barn that no longer make me feel safe for myself or my horses to be there (although I know that is not a breech of contract). I know I have my two horses there, but LEGALLY, I only have a contract signed for one, so that is all I am liable for right now. What I'm wondering, is nowhere in the contract does it say anything about what happens if I don't give a 30 day notice? I think that was still respectful of me to give a 16 day notice. Also, nothing states anything about payment for the 30 days. Is their portion of the contract violated because of the feed and turnout? I'm just so confused on how to handle this situation...to be honest, I don't feel like I owe them any money!? What is your take on this? Thanks so much!

I'm in a similar situation. We have our mare boarded at a place and it was stated and advertised private turnouts. Our mare has been out with at least 3 different horses. She has bite marks all over. There is no grass in the turnouts and they are not supplementing with hay. She has lost at least 100 pounds. I gave a 30 day notice on July 2nd. I am wanting to discuss the board cost with the BO. Because they haven't treated her as they have advertised I don't feel I owe them the full board amount for July. They have broken the board agreement by not giving her proper care in my opinion.

I'm sorry you are going through this as well! Puts us in a tough spot, because I don't want to say how I REALLY feel, in fear that they will not clean my stalls and/or not properly feed my horses. Also, something I'm not totally sure about whether this is ok or not...but they have a mailbox up inside the barn for us to put our monthly payments in. On the mailbox it states that all checks be made out to his personal name and not the business name...sound fishy??

I would take the contract to a lawyer and let them go over it and see what they have to say about it all.

That is how ours is too. Plus her boyfriend is a sherriff... My mare has an old cut on her inside left hind and it's swollen. They are supposed to notify if there is an injury and I didn't get anything.

Does the contract stipulate when giving notice what you are contractually obligated to pay?

30 days from mid July is mid August - you owe at least 1/2 of August board then, regardless of whether or not your horse is there per the 30 days notice clause. I've never left a horse at a facility for the full 30 days notice period, but I've always paid through the 30 days, a pro rated amount for any partial month.

If you feel she really will take you to small claims over it (if you pay partial she'll likely have more in court fees) than consult a lawyer first, but unless the contract clearly states you are to pay a full month after your 30 days notice, I wouldn't worry about it.

I would try to move the horse asap though.
