| The problem, I don't know what kind of an attorney I need. I sent my tax stuff to a tax prep professional who is trained in farm and ranch taxes, they filed an extension. I have used this individual in the past and my husband's family has used them for the entirety of his life. I recently received a letter from the state that my 2015 taxes were never filed. I contacted the tax professional and sent them the letter and they said they would take care of the issue and the extensions had in fact been filed. I received a second letter from the state stating my taxes are now delinquent. I have tried contacting the office on several occasions. They are not returning calls or emails. My husband spoke with some one a few weeks ago but it was after hours, the first contact we have been able to make with them since June. She claimed to know nothing and told him to call back during business hours. I called during business hours and still have no answers. They won't answer our calls, our emails or my Facebook messages. I just want my stuff so I can have the taxes handled appropriately.
What kind of attorney do I look for to handle this? I feel like from the incompetence and inability of this office my ass is getting into hot water. |

| Do you have a copy of your 2015 taxes? Or a copy of the bill that you paid for the service? If not, you are probably screwed. |

Location: East Texas | Can you go to their office in person during business hours? If so, speak to the owner/manager and let them know the situation. If you can't go in person, you may want to send them a certified letter placing them on notice that if they don't contact you and get the issues resolved, you will seek legal counsel. If they don't respond, find a tax attorney.

Do you have copies of your 2015 taxes? Even with an extension, those had to be filed by October 15, 2016. So I would think that you paid for them last year? If they are currently working on your 2016 taxes and filed an extension, then you have until October 15, 2017 to file. I'm just making sure you're tax years are straight. If they didn't file an extension for 2016, I would contact the IRS or state to see what needs to be done. As far as a lawyer, I don't have any advice there. That's such a crappy situation! |

| I have received nothing from 2015. What ever extension she filed is a long term extension. We have filed them in the past with no issues. This time it seems to be a little wonky and I am not getting straight answers. |

When you say "copies of our documents" do you mean the info she used to prepare the return or the copy of the return?

| I'd also be finding a new CPA you can sit in front of while they do your taxes...
It warrants a trip for sure to get answers, figure out exactly what needs done. I'd consider contacting a local CPA now to start a relationship, figure out where you stand with the IRS and get things corrected ASAP. We've signed a power of attorney in the past with our CPA allowing him to call the IRS on our behalf - I wonder if someone local to you can do that and get answers on your standing. |

^^^^THIS ..... set up an appointment NOW with a lOCAL tax CPA/Attorney and have them send a certified letter (with a copy to the IRS) for ALL of your records from the problem CPA.
Just a question....why would you do business with a tax CPA two states away ????

This is what I would do. I would also find out where your old CPA is licensed and finding out how to file a complaint with the licensing board. But that's just me. |

Location: Freestone TX | Never give your originals to a CPA. Give them the copies. Ditto to the suggestion to contact the state public accounting association and file a complaint. Then I'd go with a tax attorney. |

Using a CPA/tax preparer in another state is not that uncommon, esp if you have lived in that state prior or have ties to the preparer. |

Location: in the middle of backwoods iowa | ?First, call the IRS- file a complaint about the tax preparer and see if an extension has been filed. you only file Federal extensions normally- not state. Second, find someone local and have them send a letter requesting your info, you will need to send one as well to give permission for new preparer to get them. Send these certified. Third, if they do not answer hire a lawyer.
?It is your responsibility to file on time- so if late it is still your fault even if they are not ready. Do NOT ignore IRS letters- they don't like that at all. Good luck! |
