| CPS has alerted her that she is going back to her mother in December. We are devestated. The 2 year old girl was removed from her 22 year old mother last January when she violated her probation by using meth and was sent to jail. There is no exetended family for support or to care for the child. The mother also has a 5 year old daughter who went to live with her biological dad, the 2 year old has a different father who is in jail for drugs. When he was arrested high on drugs he confessed to horrible abuse of both girls and his parental rights were severed. Both girls were removed last September because of the abuse and also for neglect. The 5 year went to live with her dad but the 2 year old went to a friends house. The friend was tired of caring for her, took her to daycare and called CPS to say go get her she was not picking her up. Before the girls were removed they were living in the 42 year old father's parents house when the drugs and abuse were happening. No one reported it, no one sought medical attention for the girls. The 2 year old had broken ribs along with other injuries. CPS does not consider the mother a danger to the children. The 2 year old makes references to mommy hurting her and has meltdowns at the supervised vistis and has regressed in her potty training. The mother has found a job and has only done a few of the things required for her to get the children back. When released from jail she moved back in to the same home (abusive dad's parents who did not report the abuse). She has been out of jail 4 months, has a new boyfriend who has moved in this home with her and is 12 weeks pregnant, making this her 3rd child by a 3rd dad. What kind of guy wants to live in a grand parents house of his girlfriends baby's dad?? Someone needing a place to live, why doesn't he have his own place? CPS considers this a stable envirornment and the 3 and 5 year old are going back. The 5 year olds father was killed in a car accident 2 months ago. I am praying that something happens and she does not go back while also praying for this young mother to change her life and to learn to focus on raising her children. My neice is hoping to try and make some type of arrangement with the mother so she can maintain a relationship with the little girl and to also support the mother so these children will have a better life. This little girl is leaving the first stable and loving home she has experienced in her short little life. |

     Location: In The Land of Cotton | Many prayers for all of these poor children. I also hope the mother turns around, however, it appears she is continuing the same cycle as before. Prayers for your neice. December is still a little ways off - maybe the mother will change her mind and not want the child back. Prayers for your whole family. |

| How very, very sad. Prayers for the children and also for the unborn child and your sister. Maybe I should pray for the birth mother, but she obviously hasn't had her wakeup call yet, so I'd rather spare my efforts for the kids and your sister. |

| This breaks my heart.
In my opinion, they spend way to much time in situations like this trying to keep the family unit together.
The focus should be on the welfare of the child.
I will have this family & yours in my prayers. |

              Location: Under The Big Sky Of Texas | This is so sad, those kids should be left along and stay were they are at so they will be safe and have someone that loves them. This is just not fair for the kids, just dont understand why these babys dont have any rights to a happy life. Sometimes the law sucks and can really let us down when we need it the most, prayers for the kido's     |

         Location: MN | This story breaks my heart. There are times that I wish judges would really listen to what is going on and think more about child s needs of a stable environment when they are to young to voice their side. |

     Location: lone star state | The children should have a court appointed advocate. What is the CASA viewpoint on where the children live?
Also if the children are making statements of abuse it needs to be reported to law enforcement so a forensic interview can be scheduled. CPS is so overwhelmed with cases and they have a checklist and a timeline they follow they do not always seek what is best for the child but what is within their policy and timeframe. If mom has not completed ALL of her services then the CASA can reccommend the case be extended. In my experience Courts listen to CASA and the child's attorney over CPS reccommendations. |

| This is just heart wrenching. I can't imagine what your niece is going through. I think biological mom should have been required to have her tubes tied. Now there will another poor innocent baby born into this disaster.  |

They are meeting with her court appt attorney tomorrow. At the last hearing the 2 year olds attorney told the court she did not support the request to increase visitation, not in childs best interest, CPS was OK with it, judge ruled for increased visitation. The mother does love her children, she has had a hard life herself and made bad choices. She does not know how to be a good mother though. I feel sorry for her too.

   Location: Buffalo, TX | This is very sad for everyone....my one question in these situations is.. with all the "free" birth control, how do these irresponsible mothers keep getting pregnant??...I think I could make a good case for paying high risk or government owned women a monthly "bonus" to NOT get pregnant...it would save us all money in the long run...
I really feel sorry for these kids, and I hope they don't continue the cycle, but they probably will... |

Hopefully they are strong and can gather enough facts from the meeting tommorrow to give the judge enough to at least extend the case. One argument I would make is the new pregnancy..mom is too irresponsible to prevent until her life is more stable then how is she going to be responsible with the children she already has....also hold her feet to the fire about completing ALL of her services offered by CPS.
Also one big thing to look for is a stable home. Mom is not ready due to the fact she is not able to provide shelter to the children. Mom is dependant on others to take care of her. How is she suppose to care for two young vulnerable children!?

The advocate is who they are meeting with and who was present at the court hearing. Therapist recommended no visitation till mother proved clean and stable for 6 months, court ruled to start visitation immediately after release from prison. Judge is known to have given childen back even if all the conditions have not been met.

     Location: lone star state | To clarify the CASA is court appointed special advocate and is different person from attorney. Tbe children have an attorney and an advocate. If both are in agreement then judges generally go with their reccomendation. (Liability) the advocate needs to go to moms home. Are there beds for each child and food in the home. Is the home safe and appropriate for very young children. Take photos of the home for proof. |
