   Location: South | Anyone in the business of buying and selling horses and know all the "rules?"
Recently ran into a sticky situation where I was the purchaser and not sure what I can do, and what is the right thing for me to do. I do not do this for a living, and it has been a long time since I have bought, and normally don't sell either...and when I have sold have never had issues.
6 hours after purchasing a horse that I was told was 100% sound and had recently passed a Vet check, horse was visibly lame. Seller then admits Vet that did prior Vet check did find issues , but seller says did not know about it until they now asked- and they never noticed it while riding. Don't want to put too much out there, but if you think you could help or have experience please comment and i'll PM ya, or vice versa. Thanks |

        Location: ND | Unfotunately I doubt there is much you can do. It's never a good idea to take someone word on a horse being sound or having passed a vet check. You want to have YOUR vet perform a vet check prior to purchase to protect yourself. |

          Location: DUMPING CATS AND PIGS IN TEXAS :) | If you didn't do the vet check and the seller won't work with you, you are stuck with the horse. Sorry to be the one to tell you. You could ask for records from the vet that checked the horse. I don't know if they will let you have them......it could possibly be something treatable too. You might have some recourse with the vet records. I doubt you'll get them though. Sorry. |

       Location: Florida | If the seller has any reputation they want to protect, go for it. Take the horse back, stop payment on they check and cut and run.

Yep, cancel the check and bring the horse back. If they have cashed the check, you may have problems with them. |

           Location: Florida.. | Legally nothing........but morally the seller should take horse back BUT she can also say horse was sound when it left.. the vet cant by law give you records.. you should have had a vet check done...How many threads have been on here about that!!lol... but you didnt so Id have a vet lameness exam and see what your dealing with.. good luck..with that said though if you can prove horses prior vet records showed a preexisting major issue then go to court.. I doubt you will win but the sellers name will get dragged thru the mud and that may pursuade them to give money back..

| What are the issues the vet found during the check? It's always possible the horse got hurt in the trailer ride home. I would want more info. before I started going after the seller. Imagine if you sold a horse, it got hurt on the ride from your home to its new home, and the buyer wanted to bring back a lame horse and get their money back? Not saying this is what happened, just need more info |

| Check the laws regarding canceling a check after you purchased and possess the item that was bought, in some states this is illegal and could get you in hot water. Talk with the seller, are they willing to take the horse back? Is the lameness issue something that is chronic or acute and can be addressed without future issue effecting the horse? If it is something you could treat, even long term and still have a useable horse and would be willing to accept or if the seller is not able or willing to take the horse back, ask for a partial refund to what you think the horses actual value would be. |

Lol, I did in fact pay with a check.
The Vet check was done within 6 months. I did think maybe it could have been stiffness from the trailer ride until the seller got back to me. The seller told me they would get me more info on the Vet record because they couldn't remember specifics, but never did . All I know is that I told the seller about the lameness, and the seller pinpointed the exact location of where I saw the issue so I knew it was in fact a pre-existing condition. My Vet will charge 75 farm call and at least 75 for a lameness exam base price before having to do any blocking, or x-rays of course. I had thought about doing this but didn't want to be out that much more cash and still find out horse isn't usable. Told seller I would be bringing horse back, which is another day trip at my expense. On top of the fact that seller has limited availability of when I can bring it back to which I won't be available, and my work schedule is so hectic i'm not sure when I can get it back up there.
Thinking it may be worth having my Vet out? Highly doubt seller would take lower price just from tone of things.
