You send in the transfer with the papers, then the person on the transfer as the buyer completes the second transfer and puts their name as the seller and you as the buyer.

If you cannot get the signature of the person on the first transfer as the buyer, then fingers crossed you can get the original seller to sign another one.

If you can't you are sol

I would call AQHA and see what they would suggest on how to handle this.. I have been in this spot a few times myself and I just got ahold of the last owners on the papers and had them redo a new transfer in my name.

Clarify for us...

Person A’s name is on the papers.

Person B sold you the horse.

Who’s name is on the transfer as the seller? As the buyer?

If you don’t have the person on the papers listed as the seller on a transfer you are SOL...start Facebook stalking and hoping you can track them down.

Transfer horse into the person on the transfer. Have that person sign another transfer an put in your name. In short, horse will have to be transferred twice. That is the simplest. You will have to pay two transfer fees.

You have to send in two transfers, best if you can send them both at the same time. the first transfer as it is with the first owner as seller second owner as buyer. then send in a second transfer with the second owner as the seller and you the third owner as the buyer.  You will have to pay for both transfers.

A gal I know bought a horse that was bought and sold like an old hooker.  She had a signed transfer and she registered the horse, but like the last several owners never did any transfers and aren't listed on the papers as old owners.  

  As long as it's signed and AQHA doesn't know the difference, there's a good chance they'll register the horse.   
Not saying this is the correct, ethical, or right way of doing things, but it sure saves a heck of a lot of hoop jumping.

If you have an owner who won't cooperate, AQHA will help.  The seller can be banned from AQHA for not transferring the papers.

If you will do what I said you will not have a problem. You should have the papers back in a couple of weeks. Be sure you send both transfers at the same time (filled out and signed properly) and send the money for TWO transfers.

to a point unless seller can prove the horse in question was not paid in full, part of a divorce fued or family death. It can be a real mess.

Going through this. 
Old owner kept the papers so I "couldn't sell".  Old owner has since passed and AQHA is looking for a next of kin to sign the transfer so my boy has papers. I've done everything on my side and if AQHA can't find someone to sign the transfer, I get duplicate papers and the others are void. We've been at this for over 6 months now... AQHA is very helpful in situations where you are trying to abide by the rules and someone else didn't.
