are there laws to protect ag land & training faciilities from mining & excavating right at fenced property lines? any legal footage setback? Our race horses are in this area & an accident is inevidable. We told them that horses are flight instinct & training for us will be at risk, we have been here for 30 years & they told us to move. Please help if anyone knows of any rules to protect us, Furthermore they are digging down 40' & the ground water table is 20' how can the county planning & zoning give them a land use permit for this? The public works (county) bought a private parcel next to us, a seasonal hunting land for triple the on going price in our area. I contacted the county planning & zoning, they refused to call back & the DNR office will not return my calls either.
Go talk with a lawyer, I think that would be the way to go..
Save the money you would spend spinning your wheels on a lawyer and use it for moving expenses. Sell your place as fast as you can for as much money as you can and move. Hope prospective buyers won't know the plans for the mining development. Welcome to deregulation and the current administration's fixation with mineral extraction. You are a bug on their windshield. Don't fight it or cry about it, just accept that which you will not change. Speaking from experience. Sounds harsh, I know .but fighting about it costs you money and emotional distress and won't do any good.
