| strawfly special - 2015-03-12 12:52 PM My friend called FBI fraud dept. They told her that it had to be a crime over 50,000 for them to get involed or look into it. That's probably how she gets away with her scams!!!
Pretty sure by now it totals way over $50,000.... or you did you mean a single crime over $50,000? She is such a scam artist and needs to be stopped ASAP!!!! |

Location: Canada | I can't stand that someone like this can get away with it. I know she's not the only one who does this but really why can't there be more legal repercussions for it. |

| Per each insadent. I guess if everyone pooled together they could take to the right authorities. Could maybe get something done. I don't want her or Tyler to go to jail. I need to TALK to them in person 1st. Then I don't care what happens to them. If I could find out where they keep their horses I would be in the road in the morning. |

Wow this has been an interesting novel, I mean thread, to read. = )
Everyone who has been scammed need to file a complaint (fraud, etc ) with the State Attorney's Office. I'm no lawyer, but I also believe that if she is operating like this through multiple states that it becomes a federal crime....
Start here: http://www.justice.gov/actioncenter/report-crime
I am sure if the D.A.'s office gets enough complaints they will have to act...
Her victims dont want to file "civil" complaints, bc she could just file bankruptcy and poof its gone, but criminal (restitution ) she cannot get rid of...
Sometimes it also helps reporting her to the local news stations & papers (where she lives ), they eat stuff like this up.
In TN, it doesn't work like that, if she files bankruptcy after a civil suit, she still has to pay. I know that for a fact. |

Location: Florida | Bk is federal. It would only be nondischargeable if an adversarial complaint is filed within the bk and it is determined that the debt was fraudulent. There's a laundry list things that are considered "nondischargeable" but civil judgments are not one of them... I get rid of them in bk everyday. File a suggestion of bk within the civil case and it is put on the automatic stay, judge dismisses, case closed. |

I *think* it depends on a few more variables, if they go to court and she is court ordered to pay restitution then it doesn't matter if she files bankruptcy, she still has to pay it back. She was court ordered too. If she files it under bankruptcy, they can drag her back to court and countersue for it all over again. Which is a lot of $$$ but still. It would also depend on whether or not she is above the mean or not, which chapter she tried to file, etc. |

Yes, my friend, you are right! keyword: restitution. In which case, is criminal and it has to be ordered from a criminal case, not civil. I recently just had to do a business bk (ch 7, total liquidation) for someone, carpet installation corp, that took a whole bunch of money from people for installations, etc. There were alllll sorts of civil judgments. When he closed the corp, the people went and filed with the state attorney, anyways, they picked him up on 11 counts of fraud (something around the lines of him taking money for deposits knowing that his corp was unable to complete the tasks and would be closing). Still filed a 7 got rid of all the civil crap but he DID NOT get rid of the crim side he still had to repay them as part of the restitution that he worked out with the DA otherwise he would be sitting in the pokey.
I say that allllllll these victims need to nail her to the wall with whatever sticks, let the DA decide if it is enough to pursue crim charges. She's a scumbag thief and needs to be hit where it hurts, or locked up. She clearly has no respect for civilization as a whole or the law. It is surprising that she still out there victimizing people.

| Can anyone give me a physical address for her? I'm dealing with this cap right now. She sent me a skinny, crippled horse and she has yet to pay me back. We got an attorney and he said the first thing we need to do is get this horse back. She has paid me $100 back so far our of the thousands she owes me. She agreed that I can take this horse back bit strays away everytime I ask for her address. Someone HELP! This has been the worst situation I've ever gone through by far. |
