I'm not sure why the open range laws are being called "dumb"....if you think about it..unless you are habitually having trouble with your horses getting out because you don't care of your fences....how are you negligent if your horse gets out? The laws protect the horse owner. If my horse gets out and gets hit and the driver of the car is hurt or even killed, I sure want to know that the states laws protect me against losing everything. Its certainly not the drivers fault. Its just like hitting a deer.
With that said..I am so sorry that you lost your horse. That is so devastating. Hopefully you carry liability for your livestock through your home policy. If you don't have any state laws to protect you, your insurance will be there in the event of a law suit IF you have liability for livestock. Unless you had your horse insured, there will be no coverage there. Good luck to you.

My worst night just happened. We live on a highway. One of my horses got out, was hit and killed. My favorite horse.
I'm hoping our homeowners insurance will cover everything, but does anyone have any experience with this? A minivan hit him, and my husband said it appears to be totaled. They took the driver to the hospital, but the cop said she was up and walking around. I am so numb right now, I don't even know what to do.

I had one get hit when I was in high school 30+ years ago. Someone at the boarding stable left a gate open. My parents had a million dollar umbrella policy which was fortunate because the guy who hit the horse sued. He was also drunk and high on narcotics, but I guess the police didn't think that was important. He took my parents policy to the cleaners. It was ridiculous.
I'm very sorry for your loss. It's been 30+ years, but that night still haunts me.
