       Location: Peg-Leg Julia Grimm | Supreme Court Ruled Unanimously Last Week Against Improper Use of Amicus Briefs; Relevant for Flynn Case Allison Shelley/Getty Images3:15 The U.S. Supreme Court ruled unanimously last week against the improper use of amicus briefs by judges to shape a court case as they wish — which is what Judge Emmet G. Sullivan is doing, critics say, in the ongoing Michael Flynn case. On Tuesday, Judge Sullivan announced that he would accept amicus briefs about whether he should grant the Department of Justice’s (DOJ) motion to dismiss the case against Flynn. On Wednesday, Sullivan went a step further, appointing retired judge John Gleeson as amicus curiae (“friend of the court”) to argue against dismissal, and to argue Flynn be held in criminal contempt. (Gleeson had already expressed his views in an op-ed in the Washington Post on Monday, attacking the DOJ’s motion.) But last week, in the case of U.S. v. Sineneng-Smith, the Supreme Court held that the Ninth Circuit acted improperly by appointing three amici and directing them to brief issues that the judges wanted to consider — but the litigants had not raised. Justice Ruth Bader Ginsburg, writing for a unanimous Court, held: In our adversarial system of adjudication, we follow the principle of party presentation … [O]ur system “is designed around the premise that [parties represented by competent counsel] know what is best for them, and are reponsible for advancing the facts and argument entitling them to relief.” Id., at 386 (Scalia, J., concurring in part and concurring in judgment).
In short: “[C]ourts are essentially passive instruments of government.” United States v. Samuels, 808 F. 2d 1298, 1301 (CA8 1987) (Arnold, J., concurring in denial of reh’g en banc)). They “do not, or should not, sally forth each day looking for wrongs to right. [They] wait for cases to come to [them], and when [cases arise, courts] normally decide only questions presented by the parties.” Ibid.
While such amicus briefs could be used in “extraordinary circumstances,” the Court’s list of examples did not include cases in which prosecutors simply dropped a case. Sullivan has been criticized for inviting the intervention of amicus briefs. In a Wall Street Journal op-ed published Wednesday, for example, Harvard Law School professor emeritus Alan Dershowitz argued that judges are “umpires,” not “ringmasters”: “If the litigants come to an agreement, there is no controversy. The case is over. … Judge Sullivan should get back to the business of deciding actual controversies and get out of the business of producing political shows.” Joel B. When Durham comes out with his report (and/or possible indictments) that will really agitate them. The judge's latest stunt will accomplish nothing. All he is trying to do is force Trump to pardon him. That will be a last resort for Trump. He will let this swirl around the Democrats as long as possible. |

I don't think Durham is going to have any reports. I've read where he's coming with indictments. In fact, the prosecuters all over the country have been investigating all these people since Trump was elected. The general public doesn't know this. There are 160k + sealed indictments for all sorts of federal crimes all over the country. The normal number of sealed indictments is about 5k at any time. That means when the sh*t hits the fan, it's going to be glorious for us. The swamp is deep and wide. Their tenticles reach every crevasse and dark place. I agree the longer this is in the news, the more it wakes up the snowflakes that still have a brain left. Some will never figure out they've been screwed over. About a year ago I was really tired of all this and wanted it to end. But I'm over that now. It will take as long as it takes and I can sit back and enjoy the struggle while the swamp tries their best to wiggle out of their mess. Trump has all the information he needs, he's just trying redpill people to minimize the riots and civil unrest that will happen when the arrests of their heros are made.  #walkaway little snowflakes #Trump2020!   |

The people in the Obama administration who are in the middle of this have said they unmasked General Flynn. But there are no unmasking requests in the date range of the phone call in question. 12-29-2016. So how did they get the transcript of the phone call? Well see below. It turns out Obama can bypass legal requirements and the AG signs off on it. Imagine that. Ovomit knew and so did Loretta Lynch. The net gets wider and wider with every revelation. But this only applies to NON-American citizens. Ooops. Small problem.

He discusses expulsion of the Russian officials. So if he didn't talk about sanctions, how could it have been a lie that he said he didn't talk about sanctions with the Russian amassador?? He actually didn't mention sanctions at all. HMMMMMmmmm??? PDB means Presidential Daily Brief. Listen to Dan Bongino if you don't understand.
