     Location: Canada | NJJ is right. Don't waste your time on a signed agreement. This doesn't mean anymore then the verbal agreement. You said you wanted a good home and I commend you for that but you need to look at it this way:
You took half of the price to accommodate these people
You gave them five weeks to come up with $1000
You've asked nicely for the money with no reply
What you got in return
No response from the buyers except excuses
They injected a horse they don't own (they had money for the injection but not you?!?!)
They're buying supplies for the horse but haven't paid you.
I'm glad you want a good home but money should have exchanged hands a long time ago.Save yourself the heartache and headache and go pick him up. Something is very odd in this deal and red flags aren't just flying they're flashing bright red lights as well.
Keep us update and fingers crossed it all works out.

    Location: Being pushed over the edge, NM | I'd be taking the issue up directly with your friend/broker. Friendship and business can get along well if things are done clearly and with business in mind. Acting as a broker isn't something that should be treated lightly, it's business and should be treated as such. I've brokered horses before, your case reminds me of an issue I had with a client who I sold a horse for. My client was a nice person but lived outside of her means. She had collectors calling her so often she would change her phone number and wouldn't bother telling me, I'd have to email her or drive 40 minutes to get ahold of her. I'd even have to confirm her number was good before giving it out to potential buyers. The horse was a nice older gelding, nice barrel horse, and very affordable. I family in Colorado ended up wanting him and asked if they could do payments, which the client agreed to. I wrote up a very specific and clear contract, in which the seller would keep the horses AQHA papers until the final payment was received, and then send the papers with a signed transfer to the buyers in a timely manner, I want to say it was 2 weeks. Every time I'd run into the seller she would say she wish she would have/could have kept him. A long time passed, over a year, and I get an email from the family in Colorado who had bought the horse. They had long since paid the horse off and had yet to receive the papers. They'd contacted my client (the seller) directly and had been told the papers would be sent, and they never were. The phone number changed, and emails weren't being returned, so the poor buyers contacted me to see if I could help. I finally managed to get ahold of the seller, who hemmed and hawed. Finally, to get the buyers their papers, I had to write a letter to AQHA with a copy of the signed sales agreement, and then I sent it to the seller before I mailed it to AQHA. She realized I wasn't kidding and that AQHA would take care of the papers if she wouldn't. She finally sent the buyers their papers. This was a horse sold for $1,000 by the way. The only issues I've ever had are with the less expensive horses, the $15,000 - $40,000 horses I've sold have been done deals with no hiccups. I don't know if that's because people buying at those prices are accustomed to legal documents and read the contracts carefully before signing, and even the ones who've made payments have been perfect. Anyway, having to see the buyers be put through that, and then my having to get them the papers as per my obligations certainly wasn't any fun at all, but as the broker/agent I had a duty to both the seller and the buyer. The seller has since villianized me for it, but like I said, everything was in writing and it's business. You can't control people's personalities or their personal issues, but having proper legal documents and written communications will CYA when it comes to court and dealing with AQHA, etc. My personal opinion and advice in your situation is to put a deadline in place and stick to it. And of course in the future, a broker should have done this in writing and handled this immediately. As the seller you should also CYA with written agreements, and remember to be as clear as possible -if it's not in writing, it doesn't exist. |

Was wondering what part of the state you were in , if you were where it didnt take forever to get to I would offer to buy him from you and then find this horse a forever home. I sure do hope that you do go pick up your horse, your friend is not much of a friend to keep jerking you around this way, Shame on her for treating a friend this way.. If she was true friend she would have payed you for this horse and then get her money from these people.

           Location: Florida.. | If horse gets sick or gets infected frm injections you will end up with nothing but bills.. this is bad business.. your friend knows this.. taking advantage of you. she is collecting board and making a profit and probraly giving lessons on this horse to new owner .. id be loading up and getting the horse today.. and if buyers want horse they can go thru you.. also if buyers dont buy.... you are going to get a feed and vet bill.............watch and see.. hes your horse
