  Location: Four Corners Colorado | So 5-6 yrs ago I sold a registered horse I had on consignment with me. The owners who consigned him wanted him sold with a gelding contract and would hold the papers until he was gelded, but if they kept him they wanted him a stallion. Anyway the horse sold, and the new owners provided proof of gelding and the old owners were supposed to mail the papers and transfer to the new owners. I made sure all the info was exchanged, sent the money for the horse via money order with tracking and thought everything was good till two days ago when I got an email from the new owners saying they never got the papers.???????? I told them they would have to contact the old owner for them and now he told them I never sent him the money and I haven't been able to get a hold of him. I have proof of payment and the tracking numbers which I can no longer pull up online due to how long it has been, but I have them. Unfortunatly I have lost all the e-mails due to my computer crashing and closing old e-mail accounts. I am trying to figure out what to do. I really wish the new owners would have notifed me when the papers never came. I know the old owner got payment and proof of the gelding because the horse is now listed as a gelding with the AQHA. I'm thinking this will require a lawyer depending on what the new owners want to do.

Ditto, provide them with your tracking numbers and let them fight it out. |

| If you had saved the most important part of the transaction .... the carbon copy or stub off the money order ... the number could be traced as to who cashed it including bank or store and their signature etc etc ..
Hopefully all people buying from a horse broker will insist the broker has the papers and signed transfer before paying for the horse ...
When I sell a horse and new owner or shipper is picking it up ... I copy the packet including a signed transfer with the buyer portion blank and send copies of them to the new owner via snail or email. All the papers are in an envelope addressed to new owner in case the shipper or owner loses them and if found can be mailed to the addressee ...
I keep the same files in case something odd does happen and am glad to help with whatever the problem may be ..

I purchased a horse from BHUSA and all paperwork was in order. I transfer or register everything within a few days so I never have problems. I do not understand people buying a horse and the paperwork is not in hand or up to date. I do think the broker needs to try to straighten this out even though everything was on the up and up because you are the one buyer had communication with. I don't understand people waiting a few months much less years to transfer a horse.
You do need to check the date the horse was gelded with AQHA because the dates may not even correspond. Don't you think the seller would have contacted you before now if they had not received THEIR money? Sounds like you are dealing with some nut cases. The sad thing is this is going to fall back on you. |

  Location: Four Corners Colorado | I don't plan on ever taking in any horses on consigment in the future. I was doing the guy a favor and took 9 of his horses to sell after he ran out of pasture and was in a real bind, the horses I got were in very rough shape and I fattened them up and put training on them. He transfered all the other horses papers no problems so I had no reason to think he wouldn't for this horse. Every time I've called him he has been "out farming" So I will keep trying. This would have been so much easier if they buyers would have notifed me right away. I will be checking with the AQHA on the gelding date. Honestly part of me wonders if this is a racial thing since this buyer has an address on the reservation. I do feel bad for the buyers but I don't know what I should do if this guy won't give them the papers. Right now it is sort of wait and see and keep trying. |

Just for the record, the person that the horse is registered to is the only one who can file for lost papers. That is poor advice to give someone. |

  Location: Four Corners Colorado | Well I still haven't been able to get the previous owner to answer my calls. So I told the Buyer to find out how much the previous owner was claming was still owed on the horse. The previous owner admitted he was paid for the horse to the buyer. I told buyer that I would be sending a certifed letter to the previous owner and one to the AQHA with the contract between me and the previous owner, along with proof of payment. That information was relayed to the previous owner and now he is now willing to send the papers to the Buyer. Funny how he is willing to do that once he finds out I will contact the AQHA with my proof. Eta: when I called the AQHA this morning the Gelding date matched with the date the payment got to the previous owner.

Just for the record, the person that the horse is registered to is the only one who can file for lost papers. That is poor advice to give someone.
Well maybe things have changed but I have done it without any problem, so don't take an attitude with me missy
