As a seller I have never let one leave my property before being completely weaned. As a buyer I would expect the same.

We sell almost all of ours before weaning. We get a 25% deposit to hold them until weaning. We have a buyers sign a simple contact stating we guarantee a live healthy sound for riding foal at weaning and that the balance is due on the weaning date. Make sure you add a date that the balance is due by or the foal will be put back up for sale. Our foal price includes coggins & health papers and a new foal halter. All foals are also sold with AQHA papers we don't sell anything on certificate.

I sold my 2016 filly as a 28 day old foal. She was paid in full and the buyer put insurance on her. I did allow the buyer to take the foal and my mare and she kept them until weaning. She also had another foal on her property by my old stud (sire of both foals) so the foals were buddies and it made weaning easier. My mare came back to me in good condition.

Deposit is non-refundable. I recommend they insure, some do--some don't. We have never lost a foal after being sold, but I would think that if it did happen I would either refund their money rather than lose a good customer or let them apply it to another foal from that year or give them first shot on the next years crop.

Really would depend what your contract states, I have only had it happen one time. Colt got into the fence and required stitches---I paid the vet bill on that one, the customer actually offered to pay but I chose to.

I do 1/3 down and the balance is due on or before Oct 1st-about when I wean. They do not get a refund for lack of funds or if they change their mind, but they are guaranteed a healthy sound baby. If foal loses an eye, gets injured so it will be unsound-100% money back. If it just gets cut, they are still under purchase contract. I give a certain time frame, usually 30 days, to pick up or have weanling picked up after weaning. They get papers/signed transfer/health/coggins and a new halter and lead. Because it benefits me to sell foals while still on the mare, any vet care etc is on my dime. Once weaned and ready to go, waiting for pick up-risk is all theirs. State everything in a contract.
